According to the Law of the Republic of Kazakhstan dated 02.01.2021 No. No. 399-VI "On Amendments and Additions to Some Legislative Acts of The Republic of Kazakhstan on the Restoration of Economic Growth" citizens have the right to use part of pension savings to improve housing conditions and (or) pay for treatment that is not included in the guaranteed volume of free medical care and mandatory social health insurance, as well as for transfer to investment management by private management companies.
In accordance with the provisions of articles 30, 31 and 32 of the Law of the Republic of Kazakhstan “On Pension Provision in the Republic of Kazakhstan” (hereinafter referred to as the Law), the right to use part of their pension savings in order to improve housing conditions in their favor or spouse (wife), or close relatives and (or) to pay for treatment for themselves or their spouse, or close relatives, the following persons who have pension savings in the UAPF formed at the expense of mandatory pension contributions (MPC) and (or) mandatory occupational pension contributions (MOPC) can use:
1) the amount of pension savings of which exceeds the minimum pension savings adequacy threshold.
At the same time, the lump-sum pension payment cannot exceed the amount of the difference between the amount of pension savings at the expense of the MPC and (or) the MOPC of the contributor (recipient) and the threshold for the minimum adequacy of pension savings, calculated in accordance with the Methodology for determining the threshold for the minimum adequacy of pension savings, approved by the Government of the Republic of Kazakhstan, as of the date receiving an electronic notification from an authorized operator;
2) for whom the amount of pension, and for the persons specified in paragraph 7 of Article 11 of the Law, the amount of pension and monthly allowance provides a replacement rate for the average monthly income of the recipient at a level of at least 40 percent, determined in the manner determined by the Government of the Republic of Kazakhstan. When calculating the average monthly income replacement rate, the recipient's income preceding the retirement date, but not more than the average monthly income in the republic, is taken into account.
At the same time, the one-time pension payment cannot exceed 50 percent of the amount of pension savings at the expense of the MPC and (or) the MOPC of the contributor (recipient) as of the date of receipt of the initial electronic notification from the authorized operator;
3) those who have entered into a pension annuity agreement with an insurance company.
At the same time, the one-time pension payment cannot exceed the amount of pension savings at the expense of the MPC and (or) the MOPC on the individual pension accounts of the contributor (recipient).
Thus, pension savings can be used exclusively for the purposes and in the manner established by the legislation of the Republic of Kazakhstan. At the same time, pension savings cannot be used to pay consumer bills.
Thus, pension savings can be used exclusively for the purposes and in the manner established by the legislation of the Republic of Kazakhstan. At the same time, pension savings cannot be used to pay for consumer loans.
3) Good afternoon! I am preparing to receive my retirement savings ahead of schedule and I am interested in the question of paying personal income tax. Will I pay in full now? How will my remaining savings be paid after retirement? Are there any deductions?
In order to determine the taxation procedure for the amounts of lump sum pension payments from the UAPF, Article 351-1 of the Tax Code of the Republic of Kazakhstan “On Taxes and Other Obligatory Payments to the Budget” provides for the specifics of calculating, withholding and paying IIT (individual income tax) from lump sum pension payments in order to improve housing conditions and (or) payment for treatment carried out in accordance with the pension legislation of the Republic of Kazakhstan.
At the same time, the IIT is calculated by applying the rates established by Article 320 of the Tax Code (in the amount of 10%) to the amount of the lump sum pension payment.
Withholding and transfer of IIT from the amounts of lump-sum pension payments in accordance with paragraph 2 of Article 351-1 of the Tax Code are made by UAPF in accordance with the application of an individual for withholding IIT in one of the following ways:
1) at a time, no later than the day of making a one-time pension payment in the manner prescribed by Article 351 of the Code;
2) monthly in equal installments for no more than sixteen years according to the schedule established by the UAPF for pension payments.
IIT is withheld on the basis of an application for withholding IIT submitted by an individual to a tax agent represented by UAPF in the form established by the authorized body in agreement with the authorized body in the field of pension provision.
Thus, when an individual submits an application for withholding IIT from lump-sum pension payments in accordance with subparagraph 2) of paragraph 2 of Article 351-1 of the Tax Code, the IIT will be withheld and transferred by the UAPF upon reaching retirement age according to the schedule established by the UAPF for pension payments.
Please note that Article 351-1 of the Tax Code, which determines the specifics of calculating, withholding and paying individual income tax from a lump sum pension payment, does not provide for the provision of tax deductions. That is, tax deductions from the taxable base for calculating the IIT will not be applied only in terms of lump-sum pension payments.
Upon subsequent retirement, the recipient retains the right to apply tax deductions for pension payments from the UAPF in the manner prescribed by paragraph 3 of Article 353 of the Tax Code.
Recall that mandatory pension contributions (OPC) are not subject to individual income tax (IIT), IIT is withheld upon receipt of pension payments. In this case, tax deductions are applied (the amounts that are deducted from the tax base to calculate the amount of tax withheld).
Let's look at the numbers. For example, the payment from the UAPF is 50,000 tenge, for calculating the IIT, one minimum wage (MW) is used as a tax deduction - 42,500 tenge. In this case, the amount subject to PIT (or taxable base) will be 7,500 tenge (50,000 tenge - 42,500 tenge = 7,500 tenge). It is from this amount that the IIT in the amount of 10% or 750 tenge will be withheld.
Thus, the amount of 49,250 tenge (50,000 tenge - 750 tenge = 49,250 tenge) will be transferred to the recipient.
If the recipient previously exercised the right to a lump-sum pension payment, for example, previously withdrew 5 million tenge from his individual pension account with the payment of deferred IIT (in the amount of 10% or 500 thousand tenge) at retirement age, then the pension payment of such a recipient at retirement age will change as follows.
The amount of deferred PIT will be divided by the number of pension payments, but not more than 192 payments (deferred PIT is paid over a period not exceeding 16 years). 500,000 tenge/192 payments = 3,125 tenge.
And the recipient will be transferred an amount of 46,125 tenge (50,000 tenge - 750 tenge - 3,125 tenge = 46,125 tenge).
4) Our mother is not officially employed and earns by selling woolen things of her own making, but she is worried that in the future she will have a small pension, since she does not accrue work experience. How can this problem be solved?
Your mom can pay the Single Cumulative Payment (SCP). To become an SCP payer, you do not need to register with the tax authorities, but you only need to pay the set amount of a single cumulative payment. The amount of the monthly SCP payment is 1 MCI (in 2021 - 2,917 tenge) - for individuals living in cities of republican significance, the capital and regional significance, 0.5 MCI (in 2021 - 1458.5 tenge) - for individuals living in other settlements. Payment is made through second-tier banks in one amount to the account of the State Corporation Government for Citizens. You do not need to open a bank account to make a payment. The amount of a single cumulative payment is distributed by the State Corporation in the following proportion: 10% - individual income tax (IIT), 20% - social contributions (SC), 30% - mandatory pension contributions (MPC), 40% - deductions for compulsory health insurance (CSHI). For persons who have reached retirement age, the entire amount of the payment is recognized as individual income tax, and distribution to social payments is not made.
Thus, the SCP gives the right to participate in the funded pension system and receive a pension payment depending on the period of participation in the system and the accumulated savings. This will allow your Mom to receive a basic pension based on her proven work record. In addition, after paying the SCP, she becomes a member of the compulsory social health insurance system and will have access to medical services, unlimited in amount and types, with the right to choose a medical institution, and she will also be able to receive social benefits in cases of disability, job loss and other stipulated law cases.
Also, in order to ensure a decent pension in the future and replenish Mom's pension account, you or Mom can independently make voluntary pension contributions. It is up to you to determine the amount of the contribution and the frequency of payment of the VPC, as well as the procedure for receiving pension savings when the right to payment of the VPC occurs. To do this, it is necessary to conclude an agreement with the UAPF and transfer voluntary contributions to the UAPF to the bank details specified in the agreement. For convenience, the UAPF website has implemented a service for opening an individual pension account for accounting for DPV online using an up-to-date EDS key. In addition, it is possible to pay VPC through banking services - the Kaspi.kz application of Halyk Bank terminals. As a result, the VPC can be a great addition to the basic pension for your Mom.
