On approval of standards of public services in the field of wildlife

Order of the Acting Minister of Agriculture of the Republic of Kazakhstan dated April 30, 2015 No. 18-03/390. Registered with the Ministry of Justice of the Republic of Kazakhstan on July 28, 2015 No. 11774.

In accordance with subparagraph 1) of Article 10 of the law of the Republic of Kazakhstan dated April 15, 2013 "on public services", I order:

Approval:

1) the standard of the state service" consent to the mode of navigation during the spawning period, when fishing is prohibited, as well as on reservoirs and (or) areas where fishing is prohibited " in accordance with Annex 1 to this order;

2) standard of public service" allocation of quotas for the seizure of objects of the animal world on the basis of approved limits " in accordance with Annex 2 to this order;

3) standard of the state service "issuance of a label for caviar of sturgeon species for trade on the domestic market of the Republic of Kazakhstan" in accordance with Annex 3 to this order;

4) public service standard" approval of the installation of fish protection devices of water intake structures " in accordance with Annex 4 to this order;

5) excluded by the order of the Deputy Prime Minister of the Republic of Kazakhstan-Minister of Agriculture of the Republic of Kazakhstan dated 10.03.2017 No. 110 (entered into force on the expiration of Twenty-One calendar days after the date of its first official publication)

6) public service standard "issuing a certificate of origin of fish" in accordance with annex 6 to this order;

7) public service standard "issuance by an administrative body of permission for the import and export of animal species from the territory of the Republic of Kazakhstan to which the convention on international trade in Endangered Species of wild flora and fauna applies" in accordance with annex 7 to this order;

8) public service standard" issuance of permits for introduction, reintroduction and hybridization of animals " in accordance with annex 8 to this order;

9) standard of public service" adoption by local executive bodies of the region of decisions on the assignment of hunting grounds and Fisheries reservoirs and (or) plots to users of the animal world and the establishment of easements for the needs of hunting and fisheries " in accordance with Annex 9 to this order;

10) standard of Public Service "issuance of a permit for the use of wildlife" in accordance with annex 10 to this order;

11) the standard of Public Service" issuing a permit for the withdrawal of animal species subject to regulation " in accordance with Annex 11 to this order.

The Committee of Forestry and wildlife of the Ministry of Agriculture of the Republic of Kazakhstan, in accordance with the procedure established by law:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, send it for official publication in periodicals and in the information and legal system "Adilet" ;

3) publication of this order on the internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3.this order shall enter into force upon the expiration of Twenty-One calendar days after the date of its first official publication.

3.the State Service is provided by territorial divisions of the Forestry and Wildlife Committee of the Ministry (hereinafter referred to as the service provider).

Chapter 2. Procedure for rendering public services

4.the deadline for rendering public services from the moment of submission of the package of documents to the portal is 2 (two) business days.

The service provider verifies the completeness of the submitted documents within two working days from the date of receipt of the service recipient's documents. If the fact of incompleteness of the submitted documents is established, a reasoned refusal to further consider the application within the specified time limits.

5.the form of rendering public services: electronic (fully automated).

6.the result of rendering a public service is approval of the shipping regime during the spawning period, when fishing is prohibited, as well as on reservoirs and (or) areas where fishing is prohibited.

On the portal, the result of rendering a public service is sent to the "personal account" of the service recipient in the form of an electronic document signed with an electronic digital signature (hereinafter referred to as EDs) of the Authorized Person of the service provider and stored there.

Form of providing the result of rendering a public service: electronic.

7.The State Service is provided free of charge to individuals and legal entities (hereinafter referred to as service recipients).

8.the portal's work schedule is round - the-clock, except for technical breaks related to repair work (if the service recipient applies on weekends and holidays after the end of working hours in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the law of the Republic of Kazakhstan dated December 13, 2001 "on holidays in the Republic of Kazakhstan", acceptance of the application and issuance of the result of the provision of public services is carried out on the next working day).

9-1. the service provider refuses to provide a public service on the following grounds::

1) establishing the unreliability of documents submitted by the service recipient for receiving a public service and (or) the data (information) contained therein;

2) non-compliance of the service recipient and (or) the submitted materials, objects, data and information necessary for the provision of public services with the requirements established by the rules of water transport in reservoirs and (or) areas where fishing is prohibited during the spawning period, as well as fishing is prohibited, approved by the order of the minister of Environmental Protection of the Republic of Kazakhstan dated October 16, 2013 No. 313-P (registered in the Register of state registration of normative legal acts No. 8918) ;

3) the presence in respect of the service recipient of a court decision (sentence) that has entered into legal force on the Prohibition of his / her activities or certain types of activities that require obtaining a public service;

4) in respect of the service recipient, the presence of a court decision that has entered into legal force, on the basis of which the service recipient has lost a special right related to receiving a public service.

Chapter 3. Procedure for appealing decisions, actions (omissions) of the service provider and (or) its officials on the provision of public services

appeal against decisions, actions (omissions) of service providers and (or) their officials on the provision of public services:

the complaint is submitted to the head of the service provider at the address specified in paragraph 12 of the standard for the provision of public services, or to the head of the Ministry at the address: 010000, Astana, Kenesary STR., 36, 8 (7172) 55-58-03.

The complaint is accepted in writing by mail or on purpose on business days through the Office of the service provider or the Ministry.

Confirmation of acceptance of the complaint is registration (stamp, incoming number and date) in the Office of the service provider or the Ministry, indicating the surname and initials of the person who accepted the complaint, the time and place of receiving a response to the complaint. After registration, the complaint is sent to the head of the service provider or ministry to determine the responsible contractor and take appropriate measures.

When applying through the portal, information about the appeal procedure can be obtained by calling the Unified Contact Center 1414.

When sending a complaint through the portal, information about the application will be available from the "personal account" of the service recipient, which will be updated during the processing of applications by the service provider (a note on receipt, registration, execution, response to consideration or refusal of consideration).

The complaint of the service recipient received by the service provider or the Ministry is subject to consideration within five working days from the date of its registration. A reasoned response on the results of consideration of the complaint is sent to the service recipient by mail or issued manually in the service provider's office.

In case of disagreement with the results of the rendered public service, the service recipient may file a complaint with the authorized body for evaluating and controlling the quality of public services rendered.

The complaint of the service recipient received by the authorized body for evaluating and controlling the quality of public services is subject to consideration within fifteen working days from the date of its registration.

In the complaint:

1) an individual – surname, first name, as well as, if desired, patronymic (if available in the identity document), postal address;

2) legal entity – name, postal address, outgoing number and date. The service recipient must sign the application.

11.in case of disagreement with the results of the rendered public service, the service recipient applies to the court in accordance with subparagraph 6) of Paragraph 1 of Article 4 of the law of the Republic of Kazakhstan dated April 15, 2013 "on public services".

"Objects of the animal world on the basis of approved limits

Chapter 1. General provisions

1.state service" allocation of quotas for the withdrawal of objects of the animal world on the basis of approved limits " (hereinafter referred to as the state service).

2.the standard of Public Service has been developed by the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the Ministry).

3.the State Service is provided by Republican associations of Public Associations of hunters and subjects of hunting economy, as well as Public Associations of fishermen and subjects of Fisheries (hereinafter referred to as the service provider).

The application is accepted through the state corporation "government for citizens" (hereinafter referred to as the State Corporation).

Chapter 2. Procedure for rendering public services

term of rendering public services:

1) from the moment of submission of the package of documents to the State Corporation:

when allocating quotas for the acquisition of animal species that are hunting objects-10 (ten) calendar days after the approval of the limits for the acquisition of objects of the animal world that are hunting objects;

when allocating quotas for the acquisition of fish resources and other aquatic animals-10 (ten) calendar days after the approval of limits for the acquisition of fish resources and other aquatic animals;

2) the maximum allowable waiting time for delivery of a package of documents is no more than 15 (fifteen) minutes;

3) the maximum allowable service time is 15 (fifteen) minutes;

When applying to a state corporation, the date of acceptance of documents is not included in the deadline for rendering public services.

5.form of rendering public services: paper.

6.the result of rendering a public service is a protocol on the allocation of quotas for the acquisition of objects of the animal world on the basis of approved limits, sent to the relevant local executive bodies, or a reasoned response to the refusal to provide a public service.

When applying to a state corporation, the service recipient is sent a notice in hard copy on the allocation of quotas for the acquisition of objects of the animal world on the basis of approved limits, signed by the Authorized Person of the service provider in accordance with Annex 1 to the standard of Public Service.

7.the State Service is provided free of charge to individuals and legal entities (hereinafter referred to as service recipients).

8.working hours of the State Corporation - from Monday to Saturday inclusive, from 9.00 to 20.00 hours without lunch break in accordance with the established working schedule, except Sundays and holidays in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the law of the Republic of Kazakhstan dated December 13, 2001 "on holidays in the Republic of Kazakhstan".

In a state corporation, the state service is provided in the order of the "electronic" queue, without prior appointment and expedited service at the location of the service recipient, it is possible to book an electronic queue through the "e-government" web portal.

1) to allocate quotas for the acquisition of animal species that are hunting objects, it is necessary to provide:

The service recipient submits an application until October 1 of the next year;

2) to allocate quotas for the purchase of fish resources and other aquatic animals, it is necessary to provide:

application for obtaining quotas for obtaining fish resources and other aquatic animals on fisheries reservoirs and (or) sites in accordance with Annex 3 to this standard of Public Service;

an identity document, and for a representative - a document confirming the authority of the service recipient's representative and an identity document (for identification purposes);

certificate of the territorial transport control body on the catch and transport fleet, including a small fleet, registered in the name of the subject of Fisheries, issued no later than one month before the date of submission of the application.

The service recipient submits an application before February 1 of the previous year.

When accepting documents through a State Corporation, the service recipient is issued a receipt for accepting the relevant documents.

The service provider ensures that the result of rendering a public service through a State Corporation is delivered to the state corporation no later than one day before the end of the deadline for rendering a public service established by this standard of Public Service.

In case of failure of the service recipient to provide an incomplete set of documents in accordance with the list provided for in paragraph 9 of this standard of public services, the employee of the state corporation issues a receipt for refusal to accept the application in accordance with Annex 4 to this standard of public services.

The generated applications (together with the package of documents) are sent by the State Corporation to the service provider by courier and (or) postal communication, and a note is made on receipt by the service provider.

9-1. the service provider refuses to provide a public service on the following grounds::

1) establishing the unreliability of documents submitted by the service recipient for receiving a public service and (or) the data (information) contained therein;

2) non-compliance of the service recipient and (or) the submitted materials, objects, data and information necessary for the provision of public services with the requirements established by the rules for the distribution of quotas for the seizure of objects of the animal world, approved by the order of the Acting Minister of Agriculture of the Republic of Kazakhstan dated February 27, 2015 No. 18-04/149 (registered in the Register of state registration of normative legal acts No. 10865) ;

Chapter 3. Procedure for appealing decisions, actions (omissions) of the service provider and (or) its officials, a State Corporation and (or) its employees on the provision of public services

The complaint of the service recipient received by the service provider, Ministry or State Corporation is subject to consideration within five working days from the date of its registration.

In case of disagreement with the results of the provision of public services, the service recipient submits a complaint to the authorized body for evaluating and controlling the quality of the provision of public services.

The complaint of the service recipient received by the authorized body for evaluating and controlling the quality of public services is considered within fifteen working days from the date of its registration.

Chapter 1. General provisions

2.the standard of Public Service has been developed by the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the Ministry).

3.The State Service is provided by the Forestry and Wildlife Committee of the Ministry (hereinafter referred to as the service provider).

Acceptance of the application and issuance of the result of the provision of public services:

1) state corporation "government for citizens" (hereinafter referred to as the State Corporation);

2) "e-government" www.egov.kz, www.elicense.kz web portal (hereinafter referred to as the portal).

Chapter 2. Procedure for rendering public services"

term of rendering public services:

if natural - an electronic copy of the purchase and sale agreement;

in case of confiscation-electronic copies of the document confirming the acquisition of sturgeon fish from a state monopoly entity engaged in activities related to the withdrawal from its natural habitat, their acquisition, processing and export of caviar and other types of products, as well as a judicial act on confiscation;

if artificial - an electronic copy of information on obtaining sturgeon caviar in accordance with Annex 2 to this standard of Public Service;

3) an electronic copy of the payment order for payment for stamps, except in cases of payment via PSHEP.

In case of failure of the service recipient to provide an incomplete set of documents in accordance with the list provided for in paragraph 9 of this standard of Public Service, the employee of the state corporation issues a receipt for refusal to accept the application in accordance with Annex 3 to this standard of Public Service.

Issuance of the result of rendering a public service is carried out through a state corporation. When applying through a state corporation, the result of rendering a public service is issued on the basis of a receipt for acceptance of the relevant documents, in case of presentation of an identity document of the service recipient (or his representative by proxy), as well as on the basis of a notification if the service recipient applies through the portal.

9-1. the service provider refuses to provide a public service on the following grounds::

1) establishing the unreliability of documents submitted by the service recipient for receiving a public service and (or) the data (information) contained therein;

2) non-compliance of the service recipient and (or) the submitted materials, objects, data and information necessary for the provision of public services with the requirements established by the rules for labeling caviar of sturgeon species for trade in the domestic and foreign markets, approved by the order of the minister of Agriculture of the Republic of Kazakhstan dated January 14, 2015 No. 18-04/14 (registered in the Register of state registration of normative legal acts No. 10397) ;

Chapter 1. General provisions

1.state service" issuance by an administrative body of permission for the import and export of animal species from the territory of the Republic of Kazakhstan to which the convention on international trade in Endangered Species of wild flora and fauna applies " (hereinafter referred to as the state service).

2.the standard of Public Service has been developed by the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the Ministry).
3.The State Service is provided by the Forestry and Wildlife Committee of the Ministry (hereinafter referred to as the service provider).

Acceptance of the application and issuance of the result of the provision of public services "e-government" www.e.gov.kz, www.elicense.kz web portal (hereinafter referred to as the portal).

Chapter 2. Procedure for rendering public services

4.the deadline for rendering public services from the moment of submission of the package of documents to the portal is 3 (three) business days.

5.the form of rendering public services: electronic (fully automated).

6.the result of rendering a public service is a permit for the import into the territory of the Republic of Kazakhstan and export from the territory of the Republic of Kazakhstan of animal species to which the convention on international trade in Endangered Species of Wild Fauna and flora applies.

Form of providing the result of rendering a public service: electronic.

7.The State Service is provided on a paid basis to individuals and legal entities (hereinafter referred to as service recipients).

"In accordance with subparagraph 2) of Article 615 of the Code of the Republic of Kazakhstan" "on taxes and other mandatory payments to the budget "" dated December 25, 2017, a state fee is charged for issuing permits for the import and export of rare and endangered species of plants, animals and sturgeon, as well as their parts and derivatives, which is 2 monthly calculation indices."

Payment is made in cash or non-cash form through second-tier banks or organizations engaged in certain types of banking operations, as well as payment through the portal is made through the payment gateway of "e-government" (hereinafter referred to as PSHEP).

8.the portal's work schedule is round - the - clock, except for technical breaks related to repair work (if the service recipient applies on weekends and holidays after the end of working hours in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the law of the Republic of Kazakhstan dated December 13, 2001 "on holidays in the Republic of Kazakhstan" (hereinafter referred to as the law), acceptance of the application and issuance of the result of the provision of public services is carried out on the next working day).

an electronic copy of the export permit or certificate for reverse export when importing samples into the territory of the Republic of Kazakhstan, provided that the sample is included in annexes 1, 2, 3 to the convention on international trade in Endangered Species of Wild Fauna and flora;

electronic copy of the conclusion of the scientific organization;

An electronic copy of the document confirming payment of the state fee to the budget, except for payment via PSHEP;

an electronic copy of the hunting permit, provided that animal species, parts and derivatives are extracted from their natural habitat in the territory of the Republic of Kazakhstan.

Information on identity documents, registration (re-registration) of a legal entity, state registration as an individual entrepreneur or the beginning of activity as an individual entrepreneur is obtained by the service provider from the relevant state systems through the Gateway of "e-government".

9-1. the service provider refuses to provide a public service on the following grounds::

1) establishing the unreliability of documents submitted by the service recipient for receiving a public service and (or) the data (information) contained therein;

Chapter 3. Procedure for appealing decisions, actions (omissions) of the service provider and (or) its officials on the provision of public services

appeal against decisions, actions (omissions) of service providers and (or) their officials on the provision of public services:

The complaint is accepted in writing by mail or on purpose on business days through the Office of the service provider or the Ministry.

When applying through the portal, information about the appeal procedure can be obtained by calling the Unified Contact Center 1414.

When sending a complaint through the portal, information about the appeal becomes available from the "personal account" of the service recipient, which is updated during the processing of requests by the service provider (a note on receipt, registration, execution, response to consideration or refusal of consideration).

In the complaint:

Chapter 2. Procedure for rendering public services

2) non-compliance of the service recipient and (or) the submitted materials, objects, data and information necessary for the provision of public services with the requirements established by the rules for issuing permits for introduction, reintroduction and hybridization of animals approved by the order of the Acting Minister of Agriculture of the Republic of Kazakhstan dated February 27, 2015 No. 18-03/153 (registered in the Register of state registration of normative legal acts No. 11623) ;

Chapter 1. General provisions

7.the State Service is provided free of charge to individuals and legal entities (hereinafter referred to as service recipients).

8.work schedule of the State Corporation - from Monday to Saturday inclusive, without lunch break, from 9.00 to 20.00 hours in accordance with the established work schedule, except Sundays and holidays in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the law of the Republic of Kazakhstan dated December 13, 2001 "on holidays in the Republic of Kazakhstan".

Standard of Public Service "issuing a permit for the withdrawal of animal species, the number of which is subject to regulation"

Chapter 1. General provisions

1.state Service" issuing a permit for the withdrawal of animal species subject to regulation " (hereinafter referred to as the state service).

2.the standard of Public Service has been developed by the Ministry of Agriculture of the Republic of Kazakhstan (hereinafter referred to as the Ministry).

3.the State Service is provided by territorial divisions of the Forestry and Wildlife Committee of the Ministry (hereinafter referred to as the service provider).

Acceptance of the application and issuance of the result of the provision of public services "e-government" www.egov.kz, www.elicense.kz web portal (hereinafter referred to as the portal).

Chapter 2. Procedure for rendering public services

4.the deadline for rendering public services from the moment of submission of the package of documents to the portal is 2 (two) business days.

5.the form of rendering public services: electronic (fully automated).

6.the result of rendering a public service is a permit for obtaining animal species whose number is subject to regulation in accordance with Annex 2 to this standard of Public Service.

Form of providing the result of rendering a public service: electronic.

7.the State Service is provided free of charge to individuals and legal entities (hereinafter referred to as service recipients).

8.the portal's work schedule is round - the - clock, except for technical breaks related to repair work (if the service recipient applies on weekends and holidays after the end of working hours in accordance with the labor legislation of the Republic of Kazakhstan and Article 5 of the law of the Republic of Kazakhstan dated December 13, 2001 "on holidays in the Republic of Kazakhstan" (hereinafter referred to as the law), acceptance of the application and issuance of the result of the provision of public services is carried out on the next working day).

The complaint is accepted in writing by mail or on purpose on business days through the Office of the service provider or the Ministry.

1) an individual – last name, first name, as well as, if desired, patronymic, postal address;

2) legal entity – name, postal address, outgoing number and date. The service recipient must sign the application.
