My father died five months ago, and I didn't know then that I could inherit his retirement savings. Can I apply for them now?
In accordance with Articles 31, 32, 33 of the Law of the Republic of Kazakhstan "On Pension Provision in the Republic of Kazakhstan "(hereinafter-the Law), in the event of the death of a person who has pension savings due to mandatory, mandatory professional and voluntary pension contributions, they are inherited in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
Inheritance of pension savings is carried out by will or by law. According to the Civil Code of the Republic of Kazakhstan, in order to acquire an inheritance, the heir must accept it by submitting an application for the acceptance of the inheritance or an application for the issuance of a certificate of inheritance to a notary or an official authorized in accordance with the law to issue a certificate of inheritance. The inheritance can be accepted within six months from the date of the opening of the inheritance, i.e. within six months from the date of the death of the testator.
Given the above, we recommend that you contact a notary at the place of opening the inheritance (this is the place of residence of the deceased person).
For your information, please note that:
1) in accordance with the Law, the UAPF is obliged to make pension payments to recipients in accordance with the procedure established by the Government of the Republic of Kazakhstan. The specified procedure, as well as the list of necessary documents, are determined by the Rules for the implementation of pension payments, one-time pension payments for the purpose of improving housing conditions and (or) payment for treatment, formed at the expense of mandatory pension contributions, mandatory professional pension contributions from the unified accumulative pension fund, their return to the UAPF, approved in the wording of the Decree of the Government of the Republic of Kazakhstan;
2) in accordance with the Law, in the event of the death of the recipient, as well as a person who has pension savings in the UAPF and has not reached the retirement age in accordance with paragraphs 1-3 of Article 11 of the Law, his family or the person who performed the burial, the UAPF is paid a one-time payment for the burial within the amount of 52.4 times the monthly calculation index established for the corresponding financial year by the law on the republican budget, but no more than the funds available in the individual pension account;
3) on the UAPF website at www.enpf.kz contains a list of necessary documents, requirements for their registration, addresses of the regional divisions of the UAPF.
