Analytical report on the results of an internal analysis of corruption risks in the Office of the Akim of Atyrau region
Atyrau city January 31, 2020
On the basis of the order of the head of the Office of the Akim of Atyrau Region (hereinafter referred to as the Office) dated January 15, 2020 No. 1-НҚ from January 15 to January 31, 2020, an internal analysis of corruption risks was carried out in the Secretariat of the Assembly of the People of Kazakhstan of the Office of the Akim of Atyrau Region (hereinafter referred to as the Secretariat) for 2019 year.
The analysis was carried out in the following areas:
1) identification of corruption risks in regulatory legal acts affecting the activities of the unit;
2) identification of corruption risks in the organizational and managerial activities of the unit.
In order to identify corruption risks in regulatory legal acts affecting the activities of the Secretariat, the Law of the Republic of Kazakhstan dated October 20, 2008 "On the Assembly of the People of Kazakhstan", the Budget Code of the Republic of Kazakhstan dated December 4, 2008, Order of the Minister of Finance of the Republic of Kazakhstan dated November 24, 2014 No. 511 "On approval of the Rules for the preparation and submission of a budget request", resolution of the akimat of Atyrau region dated September 11, 2014 No. 284 of CSI "Kogamdyk Kelisim", Order of the head of the Office of the Akim of Atyrau region dated May 29, 2018 No. 191.
No corruption risks were found in the listed legal acts.
At the same time, in the course of studying the functions of the Secretariat and employees, as well as the CSI “Kogamdyk Kelisim” subordinate to it, it was revealed that in order to ensure public harmony and national unity in the Republic of Kazakhstan, an Action Plan for the Atyrau region is developed and approved on an annual basis.
So, on January 18, 2019, the Action Plan for 2019 was approved, consisting of 112 points for a total of 23 million tenge.
However, to date, there are no instructions for administrators of budget programs on budget planning of cultural and sports events. The absence of a legislative norm on regulating the financing of cultural and sports events creates a potential corruption risk in terms of unjustified overestimation of the amounts for their holding.
In order to identify corruption risks in the organizational and managerial activities of the Secretariat, the following issues were considered:
1) personnel management, including personnel turnover;
2) settlement of conflicts of interest;
3) provision of public services;
4) implementation of licensing functions;
5) implementation of control functions;
6) other issues arising from the organizational and managerial activities of the unit.
For personnel management:
The Secretariat provides for 2 staff units (Head, Chief Inspector), there were no facts of bringing employees to responsibility for corruption offenses, in addition, no disciplinary liability was found.
No affiliates were identified for the settlement of conflicts of interest.
The Secretariat does not provide public services, control and licensing functions are not carried out.
During the analyzed period, the Department published in the media:
Facebook - 267, Instagram - 251, Internet resources (assembly.kz, atyrau.gov.kz, atyraukelisim.kz) - 279, media - 209, television - 70.
In relation to the Secretariat, in the analyzed period, there were no applications from individuals and legal entities.
Based on the results of the analysis, the activities of the Secretariat revealed the absence of a legislative norm on regulating the financing of cultural and sports events.
Thus, CSI "Kogamdyk Kelisim" is recommended to submit a proposal to the authorized body for the development of relevant instructions by May 29, 2020.
