1. General Provisions
1.the Department of municipal property management is a structural division of the Department of Finance of Atyrau region.
2.The Department of municipal property management is guided in its activities by the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan, acts of the president and government, other normative legal acts, as well as this regulation.
3.the structure and staffing of the Municipal Property Management Department is approved by the head of the Finance Department of Atyrau region in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
2. Department of Municipal Property Management
main responsibilities, functions and rights
4. task: implementation of the state policy of management and privatization of regional municipal property.
Functions:
1) participation in the development of normative legal acts in the field of state property management within its competence;
2) assignment of regional municipal property to regional municipal legal entities;
3) implementation of the necessary measures in accordance with the legislation of the Republic of Kazakhstan to make a decision on the transfer of state property assigned to state legal entities from one type of state property to another;
4) implementation of the necessary measures in accordance with the legislation of the Republic of Kazakhstan to make a decision on the transfer of regional municipal property to the level of municipal property of a district, city of regional significance;
5) implementation of measures necessary for making a decision on the privatization of regional municipal property, as well as enterprises as a property complex;
6) implementation of privatization of regional municipal property, as well as enterprises as a property complex, including attracting an intermediary to organize the privatization process, ensuring the assessment of the object of privatization, preparation and conclusion of purchase and sale agreements of the object of privatization and monitoring compliance with the terms of purchase and sale agreements;
7) involvement of experts, as well as consulting, evaluation, audit and other organizations in work related to the execution of the purchase and sale agreement, including the contract that has terminated its validity;
8) exercise by the subject of the right of regional communal property in relation to regional municipal legal entities on behalf of the local executive body;
9) implementation of withdrawal or redistribution of property transferred to a regional municipal legal entity or acquired by it as a result of economic activity in agreement with the authorized body of the relevant industry (an executive body financed from the local budget that manages the relevant industry (sphere) of Public Administration, determined by the local executive body of the region) ;
10) implementation of the necessary measures to make a decision on the conclusion of a donation agreement on the property of non-state legal entities and individuals transferred to communal ownership;
11) provision of public services for the implementation of the right of state property under a donation agreement in accordance with the legislation of the Republic of Kazakhstan;
12) destruction and destruction of certain types of state property that have fallen into disrepair as a result of natural disasters and accidents, as a result of physical or moral wear and tear in accordance with the legislation of the Republic of Kazakhstan;
13) submission to the State Revenue Department of Atyrau region of information on property converted (received) into state ownership on certain grounds;
5. rights and obligations:
1) receive information from employees of the Finance Department, City and district finance departments on municipal property management;
2) make proposals to the manager on taking disciplinary measures for late performance of their duties by employees of the Department, non-compliance with ethical standards by civil servants, restrictions related to their stay in the Civil Service and other requirements of legislation;
3) perform other instructions of the manager or his deputy arising from the tasks and functions of the department, if they do not contradict the code of ethics of civil servants of the Republic of Kazakhstan;
4) ensures the safety of the Department's documents.
3. Department of Municipal Property Management
Organization of activities
6.The Department of municipal property management has the powers necessary for the implementation of its main tasks and functions in accordance with legislative acts of the Republic of Kazakhstan, acts of the president, and other normative legal acts of the Republic of Kazakhstan.
7.The Department of municipal property management is headed by a head appointed and dismissed in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
8.the head of the Municipal Property Management Department exercises general management of the Department's activities and is personally responsible for the performance of the tasks assigned to the Department and the performance of its functions.
9.the head of the Municipal Property Management Department submits proposals to the head of the institution on the structure and staffing of the Department.
10. head of the Municipal Property Management Department for this purpose:
1) defines the duties and powers of employees of the Department;
2) Exercise other powers in accordance with the laws and acts of the president of the Republic of Kazakhstan;
3) in the absence of the head of the municipal property management department, the general management of the structural division is carried out by one of the employees of the department and is personally responsible for the performance of the tasks assigned to the department and the performance of its functions;
4) performs other functions assigned by the head of the institution.
11.documents sent on behalf of the Department to other structural divisions on issues falling within the competence of the Municipal Property Management Department are signed by the head of the Municipal Property Management Department, and in case of his absence by a person replacing him.
