ON THE RESULTS OF THE INTERNAL ANALYSIS OF THE RISKS OF ANTI-CORRUPTION MEASURES CARRIED OUT IN THE STATE INSTITUTION "APPARATUS OF AKIMAT OF ESBOL RURAL DISTRICT" IN THE SECOND HALF OF 2021

In accordance with paragraph 5 of Article 8 of the Law of the Republic of Kazakhstan "On Anti-Corruption" dated November 18, 2015 and the order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated October 19, 2016 №12 Sultangaliyeva Zh.K., the chief specialist of the district, was responsible for the internal analysis of corruption risks.
An internal analysis of corruption risks was conducted from 13 to 16 September 2021.
The analysis covered the areas of identification of corruption risks in regulations governing the activities of the district akim's office, personnel management, conflict of interest management, public services, control and supervision services and other issues arising from organizational and managerial activities.
In carrying out its activities, the district akim's office uses the following regulations;
-"Constitution of the Republic of Kazakhstan" of August 30, 1995;
-"Labor Code of the Republic of Kazakhstan" dated November 23, 2015 № 414-V;
-Law of the Republic of Kazakhstan №148-II of January 23, 2001 "On local government and self-government in the Republic of Kazakhstan";
- Law of the Republic of Kazakhstan No. 221-ІІІ dated January 12, 2007 "On the procedure for considering applications of individuals and legal entities";
- Law of the Republic of Kazakhstan No. 416 of November 23, 2015 "On the state service of the Republic of Kazakhstan";
- Law of the Republic of Kazakhstan No. 434-V dated December 4, 2015 "On public procurement";
- The Code of Ethics of Civil Servants of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan No. 153 dated December 29, 2015.
In the apparatus of the akim of the Esbol rural district for the second half of 2021, the akim of the district adopted 38 decisions and 121 orders. The analysis of regulatory and legal acts did not reveal critical discretionary powers and norms that contribute to the commission of corrupt acts or decision-making. There were no proposals or protests on this issue from the judicial authorities.
The administration of the district provides public services, namely the timely and high-quality provision of public services, registration in accordance with the approved standards.
No reasons for corruption risks associated with this activity have been identified.
III. According to requests from individuals and legal entities received by the Okim's office:
In the apparatus of the akim of the Esbol rural district, the chief specialist E.S. Sabirov is responsible for checking and monitoring compliance with the requirements of the legislation on the reception, registration, accounting and consideration of applications from individuals and legal entities.
In total, in the second half of 2021, the akim's office of the Esbol rural district received 4 appeals. Of these: from individuals - 4.
4 out of 4 appeals considered in the second half of 2021 were positively resolved, 4 appeals were answered in accordance with the law, the number of repeated appeals was 0.
According to the results of the second half of 2021, the akim of the district accepted 2 residents and provided appropriate explanations.
Monthly reconciliation acts "On the procedure for considering applications from individuals and legal entities" for the second half of 2021, as well as a report on the district, were sent to the office of the Indersky district.
For the 1st half of 2021, no supervisory or other acts and proposals were received from the prosecutor's office and judicial authorities.
In the apparatus of the akim of the Esbol rural district in the second half of 2021, an analysis of the number of personnel, staffing and vacancies was carried out. According to the results of the analysis, there are 6 staff units in the district akim's apparatus. Today the actual number of civil servants is 5 people.
As a result of the analysis of corruption risks, there were no conflicts.
By order of the akim of the district No. 06-r dated January 09, 2017, the qualification requirements for administrative public positions were approved. All civil servants meet the established qualification requirements. During the reporting period, no facts of joint activities (work) of close relatives, spouses and in-laws of hired workers were revealed.
The media have not published materials that reveal illegal actions and abuses against employees of the apparatus.
Conclusion: based on the foregoing, in the activities of the state institution "Apparatus of akim of the Esbol rural district" no corruption risks and norms that allow corruption risks have been identified.
