On approval of the Rules for placement of external (visual) advertisements in the lane of public roads of international, republican, regional and district importance

To approve the attached Rules for placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance and provision of public services "Coordination of placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance", "Coordination of placement of objects of external (visual) advertisement in the right-of-way of public roads of regional and district significance", in accordance with Annex 1 to this order.
To recognize as terminated certain orders of the Ministry of Investment and Development of the Republic of Kazakhstan, in accordance with Annex 2 to this order
The Roads Committee of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan in accordance with the procedure established by the Law shall ensure:

1) state registration of this order with the Ministry of Justice;

2) within ten calendar days from the date of state registration of this order, send a copy hereof both in Kazakh and Russian languages to the Republican State Enterprise on the Right of Economic Management "Republican Center of Legal Information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

3) placing this order on the Internet resource of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan.

The control over the execution of this order shall be entrusted to the Supervising Vice Minister of Industry and Infrastructure Development of the Republic of Kazakhstan.
This order shall enter come into effect upon expiry ten calendar days after the date of its first official publication.

Rules
for placement of objects of external (visual) advertisement in the right-of-way
of public roads of international, republican, regional and district significance

Chapter 1. General provision

These Rules for placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance and for the provision of public services "Coordination of placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance", "Coordination of placement of objects of external (visual) advertisement in the right-of-way of public roads of regional and district significance" (hereinafter – the Rules) have been developed in accordance with subparagraph 1) Paragraph 3 of Article 17-1 of the Law of the Republic of Kazakhstan of December 19, 2003 "On Advertising", Article 13 of the Law of the Republic of Kazakhstan of April 15, 2013" On Public Services " and shall determine the procedure for placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance.
For placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance, individuals and legal entities shall receive approval from the regional branches of the joint stock company “National company KazAvtoZhol (hereinafter - the National operator) and ( or) a local executive body.
Acceptance of the application and issuance of the result of provision of a public service shall be carried out through the web portal of "electronic government" www.egov.kz (hereinafter-the portal).

Chapter 2. The procedure for provision of a public service "Coordination for placement of objects of external (visual)
advertisement in the right-of-way of public roads of international and republican significance"

Individuals and legal entities (hereinafter- the service recipient) in order to receive a public service "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance" shall send an application in the form of an electronic document according to Annex 1 to these Rules and an electronic copy of the sketch of the object of external (visual) advertisement of the document to the service provider through the portal.

When the service recipient submits documents, in accordance with paragraph 8 of the public service standard "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance" according to Annex 2 of these Rules (hereinafter- the Standard 1), the status on receipt of the request for provision of a public service shall be displayed in “personal account” of a service recipient.

The list of basic requirements for placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance are set out in the Law of the Republic of Kazakhstan dated December 19, 2003 "On Advertising".

The list of basic requirements for provision of a public service "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance", including the characteristics of the process, form, content and result of provision, as well as other information, taking into account the specifics of provision of a public service are set out in accordance with Standard 1.
The service provider shall carry out registration of documents on the day of their receipt and submit them for execution to the responsible executor of the service provider. When the service recipient applies after the end of working hours, on weekends and holidays in accordance with the labor legislation of the Republic of Kazakhstan, acceptance of applications, registration of a public service shall be carried out on the next working day.
The term for consideration of documents and issuance of the result of provision of a public service is 5 (five) working days.
The responsible executor of the service provider shall check the completeness of the submitted documents within 1 (one) working day from the date of registration of documents.

In cases where the service recipient submits an incomplete package of documents according to the list provided for in paragraph 8 of Standard 1, and (or) documents that have expired, the service provider shall refuse to accept the application and send a notification to the service recipient's "personal account" in the form of an electronic document signed with an electronic digital signature (hereinafter - EDS) of the authorized person of the service provider.

If the service recipient submits a full package of documents, the service provider within the time specified in paragraph 7 shall check the authenticity of the submitted documents in accordance with the requirements established by these Rules and the Law of the Republic of Kazakhstan of December 19, 2003 "On Advertising", and issue a written approval for placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance or a motivated response about the refusal to provide a public service that is sent to the "personal account" of the service recipient in the form of an electronic document signed by the EDS of the authorized person of the service provider.
Grounds for refusal to provide a public service "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance" are specified in paragraph 9 of Standard 1.
The Service provider shall ensure that data on the stage of provision of a public service are entered into the information system for monitoring the provision of public services, in accordance with the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services".

Chapter 3. The procedure for provision of a public service "Coordination for placement of objects of external (visual)
advertisement in the right-of-way of public roads of regional and district significance"

Individuals and legal entities (hereinafter- the service recipient) in order to receive a public service “Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of regional and district significance” shall send an application in the form of an electronic document according to Annex 3 to these Rules and an electronic copy of the sketch of the object of external (visual) advertisement of the document to the service provider through the portal.

When the service recipient submits documents, in accordance with paragraph 8 of the public service standard "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of regional, district significance" according to Annex 4 of these Rules (hereinafter- the Standard 2), the status on receipt of the request for provision of a public service shall be displayed in “personal account” of a service recipient.

The list of basic requirements for provision of a public service "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of international and republican significance", including the characteristics of the process, form, content and result of provision, as well as other information, taking into account the specifics of provision of a public service are set out in accordance with Standard 2.

If the service recipient submits a full package of documents, the service provider within the time specified in paragraph 7 shall check the authenticity of the submitted documents in accordance with the requirements established by these Rules and the Law of the Republic of Kazakhstan of December 19, 2003 "On Advertising", and issue a written approval for placement of objects of external (visual) advertisement in the right-of-way of public roads of international, republican, regional and district significance or a motivated response about the refusal to provide a public service that is sent to the "personal account" of the service recipient in the form of an electronic document signed by the EDS of the authorized person of the service provider.
Grounds for refusal to provide a public service "Coordination for placement of objects of external (visual) advertisement in the right-of-way of public roads of regional, district significance" are specified in paragraph 9 of Standard 2.
The Service Provider shall ensure that data on the stage of provision of a public service are entered into the information system for monitoring the provision of public services, in accordance with the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services".

Chapter 4. The procedure for appealing decisions, actions (inaction)
of the service provider on the issues of provision of public services

A complaint against the decision, actions (inaction) of the service provider on the issues of provision of public services can be submitted to the name of the head of the service provider, the authorized body, carrying out management in the sphere of automobile roads (hereinafter- the authorized body), to the authorized body for assessment and control over the quality of provision of public services in accordance with the legislation of the Republic of Kazakhstan.
The complaint of the service recipient in accordance with subparagraph 2) of Article 25 of the Law shall be subject to consideration:

- by a service provider, an authorized body - within five working days from the date of its registration;

- by the authorized body for assessment and control over the quality of provision of public services - within fifteen working days from the date of its registration.

The term for consideration of a complaint by a service provider, an authorized body, an authorized body for assessment and control over the quality of the provision of public services in accordance with paragraph 4 of Article 25 of the Law shall be extended by no more than ten working days if necessary:

1) conducting additional study or verification of a complaint or verification with a visit to the place;

2) obtaining additional information.

In the event of extension of the period for considering a complaint, an official authorized to consider complaints within three working days from the date of extension of the period for considering a complaint shall inform the applicant in writing (when filing a complaint on paper) or electronically (when filing a complaint in electronic form) to the applicant who filed a complaint on extension of the period for considering the complaint, indicating the reasons for the extension.

In cases of disagreement with the results of provision of public services, the service recipient shall apply to the court in the manner established by the legislation of the Republic of Kazakhstan.
