Regarding testing of candidates applying for the position of senior employees in the banking sector
In accordance with the Rules for issuing consent to the appointment (election) of a senior employee of a bank, a bank holding, a branch of a non-resident bank of the Republic of Kazakhstan[1], candidates applying for the position of senior employees, in cases established by these Rules, by the decision of the Commission are subject to invitation for testing for knowledge of the legislation of the Republic of Kazakhstan in the field of banking activity regulation.
Candidates are tested by computer testing in Kazakh or Russian or English for 45 minutes on 30 questions.
During the testing of candidates, audio and video recording of the testing process is conducted in the premises of the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market (hereinafter – the Agency), only Agency employees are allowed to be present in the same room with the person being tested.
When passing the test, the candidate does not use any written, electronic or other information materials, as well as other technical devices.
The candidate shall be familiarized with the test results against signature immediately after the test. In the case of remote testing, familiarization is recorded by an employee of the Agency verbally immediately after the test.
Upon receiving a positive test result (at least 70% of correct answers), the candidate is considered agreed.
In accordance with subparagraph 2) Paragraph 8 of Article 20 of the Law on Banks[2], the Agency refuses to grant consent to the appointment (election) of the bank's senior employee due to a negative test result.
Negative test results are:
the candidate's test results are less than 70% correct answers;
violation by the candidate of the testing procedure determined by the authorized body;
failure to appear for testing at the appointed time before the deadline for approval of the candidate by the authorized body.

Appeals against decisions, actions (inaction) of the Agency and (or) its officials on the provision of public services are made in accordance with the procedure provided for by the APPC[3].
