Introduction of liability insurance for owners of heavily crowded facilities

On 24 June 2025, the Head of State signed the Law of the Republic of Kazakhstan "Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Civil Defense, Electric Power Industry and State Property Management".

This Law also introduces imputed insurance of civil fire liability of owners of heavily crowded facilities.

Owners of such facilities as trade enterprises and entertainment centers with an area of over 2,000 square meters will have to enter into an insurance contract for their civil liability. Full list of facilities is determined by the Ministry of Emergency Situations of the Republic of Kazakhstan.

The insurance will cover liability for injury to life, health and property of visitors, tenants and other persons injured as a result of a fire at the facility. Along with that, activities of such facilities in the absence of a liability insurance contract are not allowed.

An insured event is recognized as occurrence of an obligation for the owner of the facility to compensate for damage caused to life, health or property of victims as a result of a fire at such facility, while the fact of occurrence of the insured event is determined as agreed by parties or a court decision subject to the terms and conditions of a standard insurance contract.

Insurance amount is established in the insurance contract and must be at least 75 thousand MCIs (295 million KZT). Amount of the insurance premium is determined by the insurer and is established in the insurance contract.

Amount of insurance payment for damage to property of one victim will be the amount of the caused damage but not more than 1.5 thousand MCIs (5.9 million KZT).

Amount of insurance payment for injury to life and health of each victim will be in the event of:

- death – 5 thousand MCIs (19.7 million KZT);

- establishment of disability:

group I – 4 thousand MCIs (15.7 million KZT);

group II – 3 thousand MCIs (11.8 million KZT);

group III group – 1.5 thousand MCIs (5.9 million KZT);

to a child – 3 thousand MCIs (11.8 million KZT);

- injury, trauma or other damage to health without establishing disability – in the amount of actual expenses for outpatient and/or inpatient treatment but not more than 750 MCIs (2.9 million KZT).

Insurance contract can be signed with any of the 15 insurance organizations for general insurance that hold a relevant license from the Agency for Regulation and Development of the Financial Market, based on a standard insurance contract.
