Agenda:
1.The Commission considered the application of citizen Ilyashev Askhat Nikolaevich for granting the right of temporary paid long-term land use to an agricultural land plot for a period of 49 years for servicing the camp" Beryozka", with an area of 1.00 hectares, located at the address: Akmola region, Zhaksyn district, within the administrative borders of Kalininsky rural district.
In accordance with Articles 48, 97 of the Civil Code of the Republic of Kazakhstan, the commission agrees and considers it appropriate: to refuse to grant citizen Ilyashev Askhat Nikolaevich the right of temporary paid long-term land use for an agricultural land plot for a period of 49 years for servicing the camp "Beryozka", with an area of 1.0 hectares, located at the address: Akmola region, Zhaksyn district, within the administrative boundaries Kalininsky rural district.
In accordance with subclause 5, clause 1, Article 48 of the Civil Code of the Republic of Kazakhstan, land plots are provided to individuals and legal entities for the operation and maintenance of buildings (structures, structures) belonging to them by right of ownership and (or) other real rights, including for the expansion and reconstruction of buildings (structures, structures) in the adjacent territory in accordance with the Legislation of the Republic of Kazakhstan. with architectural and urban planning and (or) construction documentation approved in accordance with the procedure established by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.
The requested land plot does not comply with the architectural and urban planning and / or construction documentation.
Moreover, according to Article 97of the Civil Code of the Republic of Kazakhstan, agricultural land is recognized as land provided for the needs of agriculture or intended for these purposes.
Agricultural land includes agricultural land and land occupied by on-farm roads, communications, closed reservoirs, land reclamation networks, buildings and structures necessary for the functioning of agriculture.
