Issuing or extending a permit to employers to attract foreign labor

Name of the subspecies of public service:
1. Issuance of a permit to attract foreign labor in the first, second, third, fourth categories and for seasonal foreign workers;
2. Reissue of a permit to attract foreign labor;
3. Extension of the permit to attract foreign labor;
4. Obtaining or reissuing a permit to attract foreign labor within the framework of an intra-corporate transfer;
5. Extension of the permit to attract foreign labor within the framework of an intra-corporate transfer;
6. Reissue of a permit in connection with a change in the surname, first name, patronymic, number and series of the identity document of a foreign employee and in the case of reorganization of the employer-a legal entity of the Republic of Kazakhstan or a branch (representative office) of a foreign legal entity in the form of merger, accession, division, separation or transformation, as well as in the case of a change in its name or the details specified in the permit to attract foreign labor.

The term of rendering the state service
The permit is issued within 19 working days, including:
notification of the decision to issue/extend a permit to attract foreign labor – within 8 (eight) working days;
the deadline for payment of the fee for the issuance of a permit is 10 working days, from the date of the decision to issue / extend a permit to attract foreign labor;
renewal of the permit – 6 (six) working days;
extension of the permit - 3 (three) working days;
approval of the issuance or extension of a permit with an action within more than one administrative-territorial unit – 3 working days;
notification of the decision to issue or refuse to issue a permit – within 4 (four) working days;
the deadline for making payment of the fee for the issuance of a permit is 10 working days, from the date of the decision to issue/extend a permit to attract foreign labor;
within the framework of an intra–corporate transfer:
the issuance of a permit is 8 (eight) working days;
renewal of the permit – 6 (six) working days.

The result of the provision of public services
A permit, a reissued and extended permit to employers to attract foreign labor in accordance with Annex 1 of these Rules, or a reasoned response to a refusal to provide a public service.
The form of providing the result of rendering the service is electronic.
The amount of payment charged to the employer for the provision of public services, and the methods of its collection in cases provided for by the legislation of the Republic of Kazakhstan.
The state service is provided for a fee/ free of charge to individuals and legal entities.
1) the state service for the issuance or extension of permits to attract foreign labor is provided on a paid basis according to the size of the fee rates for the issuance or extension of a permit to attract foreign labor to the Republic of Kazakhstan, approved by the Decree of the Government of the Republic of Kazakhstan dated April 3, 2018 No. 157 "On the establishment of fee rates for the issuance or extension of a permit to attracting foreign labor to the Republic of Kazakhstan";
2) the state service for the renewal of previously issued permits to attract foreign labor, as well as for the issuance, extension or renewal of permits to attract foreign labor within the framework of an intra-corporate transfer is provided to the employer free of charge.
Payment of the tax fee is carried out in cash and non-cash forms through second-tier banks and organizations engaged in certain types of banking operations within 10 (ten) working days from the date of receipt of a notification in accordance with Annex 4 of the Rules of local executive bodies of regions, cities of republican significance, the capital on their decision to issue or extend a permit to attract foreign labor force to the Republic of Kazakhstan.
The issuance or extension of permits to attract foreign labor carried out within the framework of an intra-corporate transfer is carried out free of charge.

The portal's work schedule is around the clock, except for technical breaks due to repair work (when an employer applies after the end of working hours, on weekends and holidays, according to the Labor Code of the Republic of Kazakhstan (hereinafter referred to as the Code), applications are accepted and the result of the provision of public services is issued on the next working day);
Local executive bodies of regions, cities of republican significance, the capital – from Monday to Friday from 9.00 to 18.30 hours, with a lunch break from 13.00 to 14.30 hours, except weekends and holidays according to the Code.

The list of documents and information required from the service recipient necessary for the provision of public services
1. When attracting seasonal foreign workers:
an application in the form according to Annex 2 of these Rules (hereinafter referred to as the application), certified by an electronic digital signature (hereinafter referred to as the EDS) of the employer;
information about the foreign employees involved, indicating the surname, first name, patronymic (if any) (including Latin letters), date of birth, citizenship, number, date and issuing authority of the passport (identity document), country of permanent residence, country of departure, education, name of specialty, in accordance with the applicable legislation The Republic of Kazakhstan professional standards, Qualification directory of positions of managers, specialists and other employees, standard qualification characteristics of positions of managers, specialists and other employees of organizations, the Unified Tariff and Qualification Directory of Workers' jobs and Professions, tariff and qualification characteristics of workers' professions and the State Classifier of the Republic of Kazakhstan 01-99 "Classifier of occupations" (hereinafter referred to as Qualification Requirements) in accordance with subparagraph 16-1) of Article 16 of the Code (hereinafter referred to as information on attracted foreign workers);
electronic copy of the identity document of the foreign employee;
a document confirming the payment of a fee for the issuance of a permit;
2. When attracting foreign workers in the first, second, third and fourth categories:
application certified by the employer's EDS;
information about foreign employees involved;
electronic copies of notarized educational documents and translations (if the document is not filled in in the state or Russian language) legalized in accordance with the procedure established by the legislation of the Republic of Kazakhstan, except for cases provided for by international treaties of the Republic of Kazakhstan that have entered into force;
a notarized electronic copy and translation (if the document is not filled in in the state or Russian language) of the contract for the performance of works, the provision of services (if a foreign legal entity is an employer, carries out its activities in the Republic of Kazakhstan without the formation of a branch, representative office in accordance with paragraph 39 of the Rules);
a notarized electronic copy and translation (if the document is not filled in in the state or Russian language) of a document (letter or translation agreement) agreed between a foreign employee and a foreign legal entity-employer, from which a temporary transfer of a foreign employee is carried out (if a foreign legal entity-employer sends its employees to the Republic Kazakhstan to perform works, provide services to a subsidiary, representative office, branch of a foreign legal entity, in which such a foreign legal entity-employer directly or indirectly has shares or participation interests);
an electronic copy of the employer's letter confirming that the qualifications and professional experience of a foreign employee correspond to the position to which they are being recruited;
information on the fulfillment of obligations imposed when issuing permits to attract foreign labor for the previous and current calendar years, the deadline for which has come (if any);
