About determination of the Order and the size of rendering housing assistance to low-income families (citizens) living in the Sandyktau district

In accordance with article 6 of the law of the Republic of Kazakhstan dated 23 January 2001 "About local state management and self-government in the Republic of Kazakhstan", article 97 of the law of the Republic of Kazakhstan dated 16 April 1997 "On housing relations", decree of the Government of the Republic of Kazakhstan from April, 14th, 2009 № 512 "About some questions of compensation of increase of tariffs subscription fee for the provision of telecommunication services socially protected citizens" by decree of the Government of the Republic of Kazakhstan from December 30, 2009 № 2314 "About approval of Rules of providing housing assistance", Sandyktau district maslikhat DECIDED:
1. Determine the procedure and amount of housing assistance to low-income families (citizens) living in the Sandyktau District in accordance with the Annex to this decision.
2. This decision shall enter into force from the date of state registration in the Department of justice of Akmola region and shall be enforced from the day of official publication.

Procedure and amount of housing assistance to low-income families (citizens) living in the Sandyktau District
1. procedure for providing housing assistance
1. Housing assistance is provided at the expense of the local budget to low-income families (citizens) permanently residing in the Sandyktau district.
2. to assign housing assistance, a family (citizen) (or its representative under a notarized power of attorney) applies to the non-profit joint-stock company "State Corporation "Government for citizens" and/or through the web portal "e-government", in accordance with the standard of the state service "Assignment of housing assistance", approved by the order of the Minister of national economy of the Republic of Kazakhstan dated April 9, 2015 No. 319 "On approval of standards of public services in the field of housing and communal services".

3. the assignment of housing assistance is made for the full current quarter, regardless of the date of filing the application, while family income (citizen) and utility costs are taken into account for the past quarter, with the exception of:
families (citizens) who privately own more than one housing unit (apartments, houses) or rent out premises (sublease);
families (citizens) whose able-bodied members do not work, do not study full-time, do not serve in the army and are not registered with the authorized body as unemployed (except for citizens who take care of children under 3 years of age and persons in need of care, according to the conclusion of the medical and social expert Commission).
4. The competent authority for the purpose of housing assistance is determined by state institution "Department of employment and social programs of Sandyktau area" (further — authorized body).

5. payment of housing assistance to low-income families (citizens) is carried out by the authorized body through second-level banks by crediting to the personal accounts of applicants.
6. if there is any doubt about the accuracy of the information, the authorized body shall contact the bodies authorized to carry out inspections.
7. when submitting to the authorized body knowingly false information that led to the appointment of excessive or illegal housing assistance, the owner (employer) returns the illegally received amount on a voluntary basis, and in case of refusal — in court.
2. The size of the provision of housing assistance
8. The total income of a family (citizen) applying for housing assistance is calculated by the authorized body for the quarter preceding the quarter of applying for housing assistance on the basis of the order of the Chairman of the Agency of the Republic of Kazakhstan for construction and housing and communal services dated December 5, 2011 No. 471 "On approval of The rules for calculating the total income of a family (citizen) applying for housing assistance, as well as for providing housing from the state housing Fund or housing, rented by a local Executive body in a private housing Fund" (Registered in the register of state registration of regulatory legal acts of the Republic of Kazakhstan dated February 6, 2012 No. 7412).
9. The percentage of maximum allowable expenses for the maintenance of the common property of condominium objects to families (citizens) living in privatized dwellings or are tenants (the subtenant) of the premises (apartments) in the public housing stock, consumption of utilities and communication services in terms of increasing the subscription fee phone connected to the Telecom network, families (citizens) who are owners or tenants (the subtenant) of the dwelling, rent for the use of the dwelling rented by local Executive structure in private housing stock, it is set to the total family income in the amount of 15 (fifteen) percent.
10. Housing assistance is defined as the difference between the amount of expenses paid, within the limits of the norms and the maximum allowable level of family (citizens) expenses for these purposes.
11. for the norm of housing area provided by compensatory measures, eighteen square meters per person is accepted. Payment for housing maintenance and consumption of utilities in excess of the established area norm is made on a General basis. For citizens living alone, thirty square meters, but not less than the area of a one-room apartment, is taken as the norm of housing area provided by compensatory measures.
12. set the rate of consumption of electric energy no more than 100 (one hundred) kilowatts per person per month.
13. The rate of flow of 1.5 cubic meters for each family member per month.
14. Compensation of increase of tariffs subscription fee for telephone, connected to the Telecom network shall be in accordance with the rules of compensation of increase of tariffs subscription fee for the provision of telecommunication services socially protected citizens, approved by the Government of the Republic of Kazakhstan from April, 14th, 2009 № 512 "About some questions of compensation increase rate of the subscription fee for the provision of telecommunication services to socially protected citizens."
15. Housing assistance is provided to families (citizens) living in privatized dwellings or who are tenants (sub-tenants) of residential premises (apartments) in the state housing Fund according to the estimate that determines the amount of monthly and targeted contributions for the maintenance of the common property of the condominium object, at the expense of budget funds to families (citizens) permanently residing in the Sandyktau district.
16. If the amount for housing maintenance and utilities changes, or the family income changes, the authorized body recalculates the previously accrued housing assistance.
17. acceptance of applications and issuance of results of public services is carried out according to the state service standard "Assignment of housing assistance" approved by Appendix 1 to the order of the Minister of national economy of the Republic of Kazakhstan dated April 9, 2015 No. 319 "On approval of standards of public services in the field of housing and communal services" (Registered with the Ministry of justice of the Republic of Kazakhstan on may 12, 2015 No. 11015).
18. the Authorized body makes a decision to refuse to assign housing assistance in the following cases::
1) payment for the maintenance of common property of object of condominium families (citizens) living in privatized dwellings or are tenants (the subtenant) of the premises (apartments) in the public housing stock, consumption of utilities and communication services in terms of increasing the subscription fee phone connected to the telecommunications network, the rent for use of the dwelling does not exceed the maximum permissible level of household expenditure for these purposes of 15 (fifteen) percent.
3. The order and size of providing housing assistance to poor families (citizens) with income below the poverty line, living in private houses with local heating for the reimbursement of expenses for the purchase of solid fuel
19. The housing help is appointed to needy families (citizens) with income below the poverty line, living in private houses with local heating cost recovery for utilities and the purchase of solid fuel, being owners of the houses, the tenants (with the agreement-rental housing).
