The Tourism Department of Almaty region informs that in accordance with the Law of the Republic of Kazakhstan dated April 30, 2021 "On Amendments and Additions to some legislative acts of the Republic of Kazakhstan on tourism activities" (hereinafter – the Law), the license for tour operator activity is divided into two subspecies in the field of inbound-domestic tourism and outbound tourism.
In this regard, tour operators had to bring their activities in line with the subspecies by January 4, 2022.
Also, according to line 87 of Appendix 1 of the Law of the Republic of Kazakhstan "On permits and notifications", the license for tour operator activity is inalienable, class 1. In accordance with subparagraph 11) of Article 1 of the Law of the Republic of Kazakhstan "On Permits and Notifications", license alienability is the possibility of reissuing a license to another individual or legal entity without conducting procedures to verify compliance with its qualification requirements. Accordingly, the license for tour operator activity cannot be transferred by the licensee to another legal entity or individual.
In addition, the inalienable nature of the license does not determine the validity of the license, the license for tour operator activity is not included in the list of perpetual.
Thus, after the expiration of the terms of the license in compliance, from January 4, 2022, licenses that do not comply with the legislation are invalid and cannot be used in tour operator activities.
When providing services with an unreformed license, it should be borne in mind that according to part one of Article 464 of the Code of the Republic of Kazakhstan "On Administrative Offenses", actions related to violation of licensing norms form part of an administrative offense and entail a fine of fifteen for individuals, for officials, small businesses or non–profit organizations - in the amount of forty-five, for medium–sized businesses - in the amount of eighty, for large businesses – in the amount of one hundred and fifty monthly calculation indices, with or without suspension of the license.
