In accordance with подarticle 38, paragraph 1 "Water code of the Republic of Kazakhstan " dated July 9, 2003 Almaty regional maslikhat DECIDED:
Paragraph 1 of the Annex to this decision (hereinafter referred to as The decision) of the maslikhat shall be set out in the following wording:
These rules of General water use (hereinafter referred to as the "rules")Rules) are developed in accordance withparagraph 1of article 38 "of the Water code of the Republic of Kazakhstan" (further - the Code) of 9 July 2003 and "Model rules for General water use" approved by order of Minister of agriculture of the Republic of Kazakhstan from March 20, 2015 No. 19-1 / 252(registered in the Register of state registration of normative legal acts on June 24, 2015 as No. 11434) and determine the procedure for establishing the rules of General water use by the Almaty regional maslikhat, taking into account the regional conditions of the Almaty region.
Paragraph 11 of the Annex to themaslikhat resolution should read as follows:
"The Almaty regional maslikhat during the regular or extraordinary session of the maslikhat in order to protect the life and health of citizens, taking into account the specifics of regional conditions, determines the rules of General water места use on the lakes Alakol, Balkhash, Esik and Kapshagai reservoir, where в местах купания населения не осуществляется small boats and other floating vehicles are not used in swimming areas of the population.
Use and riding in small boats and other watercraft on water bodies located on the territory of the region, including the lakes Balkhash and Alakol within the administrative borders of Almaty region, is carried out in accordance with the order of the acting Minister on investments and development of Republic of Kazakhstan from March 27, 2015 № 354 "On approval of Rules for use of small size vessels and bases (structures) for their Parking lots" (registered in the Register of the state registration of regulatory legal acts for No. 11197) and the order of the Minister of investments and development of Republic of Kazakhstan from September 24, 2018 № 669 "On approval of Rules of technical supervision over of the deck small boats" (registered in the Register of the state registration of regulatory legal acts for No. 17615), to ensure the safety of the population and the passage of small craft water user engaged in isolated or joint water use, organizes the work:
1) outside the bathing area of people for the passage of small vessels, equip a corridor fenced with buoys or milestones of bright color, a width of at least 10 meters and a length of at least 100 meters, with warning and limiting signs: "swimming in the corridor area is strictly prohibited!";
2) on the fence of the public bathing zone with buoys or milestones of bright color, with warning and limiting signs: "swimming outside the buoys is strictly prohibited!", "Riding on small vessels in the public bathing zone is prohibited!";
3) to prohibit the use of small vessels with an engine capacity of 40 HP and higher in swimming areas of the population.
Paragraph 12 of the Annex to themaslikhat's resolution should read as follows:
The akimat of Almaty region informs the population about the state of water bodies, water supply and sanitation systems located on the relevant territory.
Item 14 of themaslikhat's resolution Annex should read as follows:
To declare the conditions or prohibition of General water use, the water user performing separate or joint water use submits a proposal to the Almaty regional maslikhat, with justification for the need to establish conditions or prohibition of General water use.
Paragraph 15 of themaslikhat's resolution Annex should read as follows:
Declared conditions or prohibitions of shared water use should not restrict the implementation of shared water use to meet economic and drinking purposes.
Annex to theresolution of the mAslihat should be supplemented with item 14-1:
Almaty regional maslikhat, during the regular or extraordinary session of the maslikhat, takes an appropriate decision on establishing conditions or prohibiting General water use and sends it to the water user within three working days.
Appendix Рof themaslikhat's resolution should be supplemented with item 15-1:
After receiving a positive decision from the Almaty regional maslikhat of waterоusers through the mass media, as well as through special information signs, provides notification of the population about the prevention of bathing and other conditions of General water use.
