In accordance with subparagraph 23-24) of article 20 of the Law of the Republic of Kazakhstan dated July 16, 2001 "on architectural, urban planning and construction activities in the Republic of Kazakhstan" and subparagraph 1) of article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "on public services", I ORDER:

1. Approve the attached Rules for accreditation of project management organizations in the field of architecture, urban planning and construction.
2. the Committee for construction, housing and communal services and land management of the Ministry of national economy of the Republic of Kazakhstan shall provide:
1) state registration of this order in the Ministry of justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this order, send a copy of it for official publication in periodicals and in the information and legal system "Adilet";
3) placement of this order on the Internet resource of the Ministry of national economy of the Republic of Kazakhstan.
3. Control over the implementation of this order shall be assigned to the supervising Vice-Minister of national economy of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of twenty-one calendar days after the date of its first official publication.

Rules for accreditation of project management organizations in the field of architecture, urban planning and construction

Chapter 1. General provisions
1. These rules for accreditation of project management organizations in the field of architecture, urban planning and construction (hereinafter – the Rules) are developed in accordance with subparagraph 23-24) of article 20 of the Law of the Republic of Kazakhstan dated July 16, 2001 "on architectural, urban planning and construction activities in the Republic of Kazakhstan" and subparagraph 1) of article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "on public services".
2. the Rules regulate the procedure for accreditation of organizations for project management in the field of architecture, urban planning and construction and define the procedure for providing the state service "Accreditation of organizations for project management in the field of architecture, urban planning and construction".
3. these Rules apply the following concepts:
1) accreditation – the procedure for official recognition by the authorized body of the organization's authority to manage projects in the field of architecture, urban planning and construction;
2) certificate of accreditation – a certificate certifying the status of a project management organization in the field of architecture, urban planning and construction;
3) applicant – a legal entity applying for accreditation as a project management organization in the field of architecture, urban planning and construction;
4) authorized body – local Executive bodies of regions, cities of Republican significance, the capital.
Chapter 2. Rules and eligibility requirements
4. State service "Accreditation of project management organizations in the field of architecture, urban planning and construction" (hereinafter-state service) it is provided by local Executive bodies of regions, cities of Nur-Sultan, Almaty and Shymkent (hereinafter - the service provider) in accordance with these Rules.
5. Legal entities (hereinafter referred to as the service recipient) send an application with documents in the form of an electronic document certified by an electronic digital signature (hereinafter referred to as the EDS) to the service provider via the e-government web portal www.egov.kz (hereinafter - the portal).
A list of the main requirements for the provision of public services, including the characteristics of the process, the form, content and result of rendering, and also other information taking into account characteristics of the public service set out under Annex 1 to this Regulation in the form of a standard of the state service (hereinafter – the Standard of the state service).
6. the List of documents required for the provision of public services is determined by paragraph 8 Of the standard of public services.
Information about documents on state registration (re-registration) of a legal entity is provided to the service provider from information systems via the "e-government"gateway.
The service recipient consents to the use of information that is a legally protected secret contained in information systems.
The service recipient is sent the status of acceptance of the application for the provision of public services to the" personal account", indicating the date and time of receipt of the result of the public service.
7. Actions that are part of the process of providing public services, the duration of performance:
1) automatic registration of the application with the documents specified in sub-paragraphs 1) and 2) of paragraph 6 of these Rules;
2) issuance and reissue of the certificate in electronic form is carried out by an information system (computer) without the participation of the service provider – within 20-40 (twenty - forty) minutes.
8. The accreditation certificate must be reissued if you change the name and (or) the location of the legal entity.
9. The service provider provides data entry on the stage of rendering the state services in the information system of monitoring of public services in the procedure established by the authorized body in the sphere of Informatization in accordance with subparagraph 11) of paragraph 2 of article 5 of the Law.
10. Organization project management in the field of architecture, urban planning and construction, accredited, included in the Register of accredited organizations for the management of projects in the field of architecture, urban planning and construction, in the form of Annex 6 to this Regulation, which contains a record of the details of the legal entity, date of issuance and number of the accreditation certificate, the presence of staff specialists, as well as information on measures taken in respect of this legal entity the measures of responsibility established by the laws of the Republic of Kazakhstan.
11. Suspension, renewal, revocation (revocation) of the accreditation certificate is carried out in accordance with the procedure and (or) on the grounds provided for in article 45 of the Law of the Republic of Kazakhstan "on permits and notifications".
12. It is not allowed to operate an organization without a valid certificate of accreditation.
13. The Register of accredited organizations provided for in paragraph 10 of these Rules shall be amended and supplemented on the basis of an application from an accredited organization in accordance with Annex 7 to these Rules.
At the same time, any changes and additions made do not entail a violation of the licensing requirements provided for in Annex 3 of these Rules.
Chapter 3. Procedure for appealing decisions, actions (inaction) of service providers and (or) their officials on the provision of public services
14. a Complaint against the decision, actions (omissions) of the service provider on the provision of public services may be submitted to the head of the service provider, the authorized body, to the authorized body for assessment and control of the quality of public services in accordance with the legislation of the Republic of Kazakhstan.
15. The complaint of the service recipient in accordance with subparagraph 2) of paragraph 2 of article 25 of the Law is subject to review:
by the service provider or authorized body - within five business days from the date of its registration;
by the authorized body for assessment and control of the quality of public services-within fifteen working days from the date of its registration.
16. The term of consideration of the complaint by the service provider, the authorized body, the authorized body for assessment and control of the quality of public services in accordance with paragraph 4 of article 25 of the Law is extended for no more than ten working days in cases of necessity:
1) conducting an additional investigation or verification of the complaint or a field check;
2) for more information.
In the event of an extension of the complaint review period, the official authorized to review complaints shall, within three working days from the date of extension of the complaint review period, inform the Complainant in writing (when filing a complaint in hard copy) or electronically (when filing a complaint in electronic form) of the extension of the complaint review period, indicating the reasons for the extension.
In cases of disagreement with the results of the provision of public services, the service recipient applies to the court in accordance with the legislation of the Republic of Kazakhstan.
