1. General provisions
1. State institution "Management of state architectural-building control of Almaty region" (further - Management) is the state body of the Republic of Kazakhstan, carrying out management in the sphere of the state architectural and construction control and supervision, licensing, certification and accreditation in accordance with the legislation of the Republic of Kazakhstan on the territory of Almaty region.
2. Management does not have offices.
3. the Department carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as these Regulations.
4. the Department is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.
5. Control enters in civil-legal relations from own name.
6. the Office has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the law.
7. The office for matters within its competence in accordance with legislation makes decisions, execute orders of the head of the Department and other acts, stipulated by the legislation of the Republic of Kazakhstan.
8. The structure and limit of the staff of the Department are approved in accordance with the current legislation.

If the Management of legislative acts is granted the right to carry out income-generating activities, the income received from such activities is sent to the state budget.

14. mission of the Department: in accordance with the Law of the Republic of Kazakhstan "on architectural, urban planning and construction activities in the Republic of Kazakhstan" - implementation of state architectural and construction control and supervision, licensing, certification and accreditation in the field of architectural, urban planning and construction activities in the Almaty region.
15. Tasks:
1) implementation of the state architectural, urban planning and construction policy on the territory under its jurisdiction;
2) monitoring of facilities and complexes under construction (planned for construction) in accordance with the procedure established by the Government of the Republic of Kazakhstan;
3) improvement of the system of public administration in the field of state architectural, urban planning and construction activities, further development and preparation of proposals for improving the legislative acts of the Republic of Kazakhstan regulating issues of architectural and urban development;
4) within its competence, ensuring compliance with the requirements of the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities in the territory of the Almaty region;
5) implementation of other tasks assigned to local Executive bodies by the legislation of the Republic of Kazakhstan in the interests of local government.
16. The Control functions defined in accordance with the Codes of the Republic of Kazakhstan "On administrative offences", "Entrepreneurial code of the Republic of Kazakhstan", Laws of the Republic of Kazakhstan "On combating corruption", "On state service of the Republic of Kazakhstan", "About architectural, town-planning and construction activities in the Republic of Kazakhstan", "About permissions and notifications", "On the procedure of consideration of physical and legal persons", the Resolution of the Government of the Republic of Kazakhstan "On approval of register of public services»:
1) implementation of state architectural and construction control and supervision over the quality of construction of objects, application of administrative measures established by the legislation of the Republic of Kazakhstan to violators of architectural and urban planning discipline at these objects;
2) licensing of activities in the field of architecture, urban planning and construction;
3) certification of experts for the right to carry out expert works and engineering services in the field of architectural, urban planning and construction activities;
4) accreditation of project management organizations in the field of architecture, urban planning and construction;
5) making decisions on applying to violators of the provided legislative measures in connection with violations and deviations from the norms of legislation, state regulatory requirements, conditions and restrictions established in the field of architectural, urban planning and construction activities;
6) taking measures for violation of the legislation of the Republic of Kazakhstan in the implementation of engineering services (technical supervision and project management) and expert work (project expertise and technical inspection of reliability and stability of buildings and structures) by accredited legal entities, as well as for certification of engineering and technical employees involved in the design and construction process, in violation of the requirements of the legislation of the Republic of Kazakhstan and other normative and regulatory legal acts in the field of architecture, urban planning and construction;
7) during the inspection of objects, it sets:
availability of approved design (design and estimate) documentation, a positive conclusion of the project expertise, as well as notification of the bodies that carry out state architectural and construction control and supervision of the beginning of construction and installation works;
validity of the data specified in the notification;
availability of a license for the right to carry out the relevant types of licensed architectural, urban planning and construction activities;
compliance of completed construction and installation works, used construction materials (products, structures) and equipment with approved design solutions and state (interstate) standards, including ensuring the strength, stability, reliability of load-bearing and enclosing structures and operational qualities of buildings (structures);
organization and implementation by the contractor (General contractor) of all types and forms of its own production control and supervision of the quality of construction (input, operational, acceptance, laboratory, geodetic, and others);
the timeliness and correctness of registration of Executive documentation;
organization and implementation by the customer (owner) of technical supervision in the construction of objects subject to acceptance for operation by state acceptance and acceptance commissions;
organization by the customer (owner) of author's supervision in the construction of objects subject to acceptance into operation by state acceptance and acceptance commissions;
compliance with technical and author's supervision established by state standards for the implementation of technical and author's supervision (engineering services) in the field of architecture, urban planning and construction;
8) carry out inspections for:
the customer (developer) has documents confirming their respective rights to this land plot, and an agreement with the contractor (General contractor);
timely execution and maintenance of Executive technical documentation by construction participants, including when making changes to the approved design and estimate documentation;
the quality of the construction materials, products and structures used, the equipment to be installed, and the availability of appropriate certificates;
compliance of completed construction and installation works, used construction materials (products, structures) and equipment with approved design solutions and state (interstate) standards, including ensuring the strength, stability, reliability of load-bearing and enclosing structures and the performance of buildings (structures);
organization and implementation of construction with the support of technical and author's supervision;
9) monitoring of objects under construction (planned for construction) and quality control of objects and complexes under construction (reconstructed, expanded, modernized, overhauled) ;
10) participation in the work of acceptance and state acceptance commissions in accordance with the procedure established by law;
11) taking measures established by law in relation to legal entities and officials who have committed violations that cannot be eliminated or who have not eliminated the violations committed within the established regulatory deadlines;
12) determination of the applicant's compliance with the qualification requirements when issuing the license and the Appendix to the license;
13) implementation of licensing control, including taking appropriate measures against violators of licensing rules based on the results of unscheduled inspections;
14) maintaining a register of applicants for licenses and licensees in the field of architecture, urban planning and construction;
15) conducting organizational activities for certification of experts who provide expert work and engineering services (electronic testing);
