Prosecutors of kegen district explained the principles of functioning of the three-link model of Criminal Procedure.
The three-link model of Criminal Procedure is a law enforcement system that has come into force in all developed countries. The creator of these three links is the police, the prosecutor's office and the court. This composition is responsible for criminal proceedings. Each stage of the three-generation system serves as a filter, which must be passed before the case is sent to the court.
"The transition to the three-link model requires a change in the approaches of pre-trial investigation and organizational skills of both prosecutors and investigators. In this regard, the prosecutor general's office together with all pre-trial investigation bodies has started a gradual "easy" transition to a three-link model of Criminal Procedure," said A. B. Sadykov, senior prosecutor of the kegen District Prosecutor's office.
The three-link simulation showed that the prosecutor's decision will be one of the key decisions in criminal proceedings, doubling the burden of responsibility for investigating a criminal case. Now, without the consent of the prosecutor, decisions on recognition of a suspect, determination of the qualification of the suspect's actions, qualification of a criminal offense, termination of the terms of pre-trial investigation, as well as the protocol on a criminal offense are considered illegal.
These changes will protect the constitutional rights of citizens, including both the suspect and the victim, and prevent the facts of unjustified involvement in the criminal process, and ensure the objectivity of the investigation as a whole.
