1. General provisions
1. the state institution "Department of entrepreneurship and industrial and innovative development of Almaty region" (hereinafter - the Department) is a state body of the Republic of Kazakhstan that provides leadership in the areas of entrepreneurship, trade, industrial and innovative development and subsoil use.
2. Management does not have offices.
3. the Department carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
4. The office is a legal entity in organizational-legal form of state establishment, has seals and stamps with its name in state language, forms of the established sample in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.
5. Control enters in civil-legal relations from own name.
6. the Department has the right to act as a party to civil relations on behalf of the state, if it is authorized to do so in accordance with the law.
7. The office for matters within its competence in accordance with legislation makes decisions, execute orders of the head of the Department and other acts, stipulated by the legislation of the Republic of Kazakhstan.
8. The structure and staff limit of the Department are approved in accordance with the current legislation.
9. Location of the legal entity: index 040000, Republic of Kazakhstan, Almaty region, Taldykorgan city, Shevchenko street, no. 131.
10. Full name of the state body – state institution "Department of entrepreneurship and industrial and innovative development of Almaty region".
11. This regulation is the Foundation document of the Department.
12. the Department's activities are Financed from the local budget.
13. Management is prohibited from entering into contractual relations with business entities for the performance of duties that are Management functions.
If the Management of legislative acts is granted the right to carry out income-generating activities, the income received from such activities is directed to the revenue of the Republican budget.
2. Mission, main tasks, functions, rights and responsibilities Management
14. mission of the Department: creating conditions for the development of business and trade activities, investment climate, industry and raw materials sector in the territory of Almaty region.
15. Tasks:
1) implementation of the state policy for the development and support of private entrepreneurship in accordance with the legislation;
2) ensuring the implementation of the state trade policy;
3) implementation of the state policy of industrial and innovative development;
4) ensuring the execution and termination of contracts for the exploration or production of common minerals.
16. Functions:
1) implementation of the state policy of support and development of private entrepreneurship;
2) creating conditions for the development of private entrepreneurship;
3) ensuring the creation and development of small business and innovation support infrastructure in the region;
4) regulating the activities of trade entities within their competence;
5) implementation of state programs Republic of Kazakhstan;
6) issuance of licenses and reissue of duplicate licenses to carry out activities for the collection (procurement), storage, processing and sale of scrap and waste of non-ferrous and ferrous metals;
7) ensuring state regulation and coordination of the activities of trade markets regardless of ownership, assigning a category to markets in accordance with the rules for organizing the activities of trade markets and their types;
8) implementation of state control over compliance with the maximum allowable retail prices for socially important food products within its competence;
9) organization of the work of the Commission for the management of the regional stabilization Fund of the region;
10) organizing the activities of expert councils on entrepreneurship and meetings of the regional coordinating Council;
11) development and approval of the regional industrialization map areas;
12) implementation of state policy in the sphere of functioning of special economic and industrial zones;
13) conclusion, registration and storage of contracts for exploration and production of common minerals;
14) forming a list of goods, works and services produced on the territory of the region and their producers;
15) ensuring coordination of the implementation of sectoral programs in the field of industrial and innovative activities in the region;
16) management of the joint-stock company "national company" Social and entrepreneurial Corporation "Zhetysu", limited liability partnership " Regional development center of Almaty region»;
17) exercise in the interests of local government other powers assigned to the Management by the legislation of the Republic of Kazakhstan.
17. Rights and obligations:
1) request and receive the necessary information and materials from state bodies, organizations, and their officials in accordance with the procedure established by law;
2) ensure coordination of the functioning of special economic and industrial zones in the region;
3) take measures to prevent the Commission of corruption offenses and crimes;
4) exercise other rights and obligations in accordance with the legislation of the Republic of Kazakhstan.
3. The organization of the Department
18. Manual Control is the first leader who is personally responsible for fulfilling Management objectives and the performance of its functions.
19. the First head of the Department is appointed and dismissed by the Governor of the region.
20. the First head of the Department has deputies who are appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
21. Powers of the first head of the Department:
1) appoint and dismiss employees of the Department in accordance with the legislation of the Republic of Kazakhstan;
2) encourages and imposes disciplinary penalties on employees of the Department;
3) within the limits of its competence, issues orders and instructions that are mandatory for the employees of the Department;
4) counteract corruption in Management with the establishment of personal responsibility for it;
5) within its competence represents the interests of Management in state bodies and organizations in accordance with the legislation of the Republic of Kazakhstan;
6) make decisions on other issues related to its competence.
Execution of the powers of the first head of the Department during his absence is carried out by the person who replaces him in accordance with the current legislation.
22. the First head determines the powers of his deputies in accordance with the current legislation.
23. the Department is headed by the head of the Department appointed and dismissed in accordance with the current legislation of the Republic of Kazakhstan.
4. Property Management
24. the Department may have separate property on the right of operational management in cases stipulated by the legislation.
Property Management is formed by the property transferred to it by the owner, and property (including cash income), acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
25. the Property assigned to the Management belongs to communal property.
26. the management has no right to independently alienate or otherwise dispose of the property assigned to It and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.
5. Reorganization and abolition of Management
27. the management is Reorganized and abolished in accordance with the legislation of the Republic of Kazakhstan.
