The procedure for the appointment of state targeted social assistance

The appointment of targeted social assistance is carried out by the authorized body within the limits of the amounts provided for in the relevant budget for the provision of targeted social assistance.

Targeted social assistance is assigned to each family member who has the right to receive it.

For the purposes of this Law, the family includes cohabiting family members who are bound by property and personal non-property rights and obligations arising from marriage( matrimony), kinship, property, adoption (adoption) or other form of adoption of children for upbringing, as well as cohabiting persons who are actually cohabiting, but are not married, with the exception of persons:

1) being on full state support;

2) who are on active military service;

3) being in places of deprivation of liberty, on compulsory treatment.

The fact of cohabitation is not required:

able-bodied family members who carry out work activities outside the family's place of residence;

children attending residential institutions, except those on full state support and students in full-time education in the organizations of secondary, technical and vocational, secondary, higher and (or) postgraduate education of the Republic of Kazakhstan, after they reach adulthood to the time of completion of educational institutions (not longer than before achievement of age twenty-three).

The employment center of the population or the akim of a village, village, or rural district registers an application for the appointment of targeted social assistance and issues a confirmation of acceptance of the application to the applicant.

The employment center of the population or the akim of a settlement, village, rural district after accepting the application within one working day passes it to the precinct commissions for the preparation of a conclusion.

Akim of the village, village, rural district no later than three working days from the date of receipt of the conclusion of the precinct commission sends a package of documents to the employment center.

The center of employment of the population:

1) ensures the activities of the district (city) or regional commission on employment of the population;

2) monitors the implementation of individual plan activities and assesses the effectiveness of the implementation of the social contract;

3) through social work consultants and assistants, assist recipients of targeted social assistance in implementing the individual plan and fulfilling their obligations under the social contract.

In the process of accepting an application for the appointment of targeted social assistance, an interview is conducted with the applicant and (or) his family members, during which they are determined:

1) grounds for receiving unconditional or conditional monetary assistance;

2) the need for measures to promote employment;

3) measures of social adaptation, which includes measures of social rehabilitation of the disabled specified in article 21 of the Law of the Republic of Kazakhstan "About social protection of invalids in the Republic of Kazakhstan", special social services to persons in difficult situations, in accordance with the Law of the Republic of Kazakhstan "On special social services" and other measures of state support in accordance with the legislation of the Republic of Kazakhstan.

If the applicant and (or) his family members need measures to promote employment and (or) social adaptation, the decision to provide which is beyond the competence of the authorized body, an application with the attachment of information obtained from information systems for the purpose of targeted social assistance, in writing from the relevant state bodies and (or) organizations, as well as documents submitted by the applicant due to the lack of information in the relevant information systems of state bodies and (or) organizations, it is sent by the employment center for consideration by the district (city) or regional commission on employment of the population.

The tasks of the district (city) and regional commissions on employment issues include:

coordination of the activities of interested bodies and organizations in the appointment of targeted social assistance;

development of recommendations on the provision of measures to promote employment and social adaptation;

consideration of issues on the provision of a one-time payment of conditional cash assistance monitoring of the implementation of concluded social contracts.

The employment centre after obtaining the opinion of the precinct election Commission or of documents with the conclusion of the precinct election Commission from the akim of settlement, village, rural district, and, if necessary, the recommendation of the district (city) or a regional Commission on questions of employment within three working days is an individual plan that specifies the list of measures to promote employment and social adaptation of the family (person) and concludes with the applicant a social contract.

The forms of the social contract, the individual plan and the standard list of measures to promote employment and social adaptation of the family (person) are approved by the central executive body.

The employment center within one working day from the date of conclusion of a social contract directs the application with the information received from the information systems for the appointment of targeted social assistance, in written form from the relevant state bodies and (or) organizations, as well as documents submitted by the applicant in connection with the lack of information in relevant information systems of the state bodies and (or) organizations, the draft decision on the appointment of targeted social assistance and the social contract signed by the parties to the authorized body for the appointment of targeted social assistance.
The authorized body, within three working days from the date of receipt of the documents specified in paragraph 6 of this article, makes a decision on the appointment of targeted social assistance or refusal to appoint it, and notifies the applicant in writing through the employment center or the akim of the village, village, rural district, in case of refusal – with an indication of its reason.
The authorized body has the right to request from the relevant authorities the information necessary for the consideration of the documents submitted for the purpose of targeted social assistance.
The social contract with the recipients of conditional monetary assistance is concluded for the period of assignment of conditional monetary assistance.

10-1. In the event of changes in the conditions of participation in employment promotion measures and (or) the conditions for the provision of social adaptation measures, the social contract shall be amended and supplemented by agreement of the parties by signing an additional agreement to the social contract.

Unconditional cash assistance is assigned for the current quarter from the month of application and is paid monthly.

Conditional cash assistance is assigned for the current quarter from the month of application and is paid monthly or in a lump sum for the period specified in the social contract.

The amount of one-time payment of conditional cash assistance is used exclusively for activities related to the fulfillment of obligations under the social contract, the development of personal subsidiary farming (purchase of livestock, poultry, etc.), the organization of individual business activities (except for the costs of repayment of previous loans, purchase of residential real estate).

A social contract with recipients of conditional monetary assistance is terminated if a low-income person (family) fails to fully comply with the terms of the social contract and individual plan activities, including participation in employment promotion measures and employment, as well as the submission of false information and (or) false documents that have resulted in illegal assignment and (or) payment of conditional monetary assistance.

Termination of the social contract is the basis for termination of payment of conditional monetary assistance to a person (family).

The applicant and the recipient have the right to appeal against the actions of the akim of the village, village, rural district, employment center and decisions of the authorized body and its officials in higher local executive bodies, as well as in court.
Officials of the authorized body and the employment center are responsible for the correct appointment and organization of payment of targeted social assistance in accordance with the laws of the Republic of Kazakhstan.
The authorized body and the employment center are obliged to inform the population through the mass media about the procedure and conditions for providing targeted social assistance.
