ANALYTICAL REPORT on the results of internal analysis of corruption risks in the activities of the Akim's office of the Avatsky rural district

INTRODUCTION
Based on the order of the Akim of the Avatsky rural district No. 20 of March 19, 2021 "On Conducting an internal analysis of corruption risks", an internal analysis of corruption risks for the first quarter of 2021 was conducted.
The office carries out its activities on the basis of the Regulations of the state institution "Office of the Akim of the Avatsky rural District" approved by the Resolution of the Akimat of the Enbekshikazakh district of January 12, 2018 No. 13.
The mission of the state institution "Akim's Office of Avatsky rural District" is to implement state policy in the territory of Avatsky rural district of Enbekshikazakh district.
Internal analysis of corruption risks was carried out in the following areas::
IDENTIFICATION OF CORRUPTION RISKS IN REGULATORY LEGAL ACTS
1.The state institution "Apparatus of the Akim of the Avatsky Rural District" in its activities is guided by the Constitution and Laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, and other normative acts, as well as the Regulations on the state institution "Apparatus of the Akim of the Avatsky Rural District".
IDENTIFICATION OF CORRUPTION RISKS IN THE ORGANIZATIONAL AND MANAGERIAL ACTIVITIES OF THE AKIM'S OFFICE OF THE AVATSKY RURAL DISTRICT
The work of the personnel service in the state institution of the "Office of the Akim of the Avatsky rural district", including hiring and dismissal:
The number of civil servants of the state institution" Apparatus of the Akim of the Avatsky rural district " according to the staffing table is 8 people.
According to this stage, a leading specialist Galiyev Temirlan Kairatovich was hired on November 02, 2020, through a general competition for one vacant place.Currently, there are no vacant positions. There are no dismissed employees in July-December 2020.
Personnel management, including staff turnover issues, is carried out through the Unified Department of the Personnel Management Service (HR service) of the Enbekshikazakh district.
In order to comply with the anti-corruption legislation, all civil servants of the unit have adopted anti-corruption restrictions and to implement financial control measures, employees and their spouses have submitted timely declarations to the state revenue authorities. There are no facts of violation of anti-corruption restrictions and prohibitions.
Recommendation: Frequency of appropriate actions and strengthening of responsibility of civil servants in order to prevent shortcomings in the implementation of the Law of the Republic of Kazakhstan "On Corruption".
In the field of public service provision:
In the current period, the total number of public services provided in the office is 6 types: placing children of preschool age (up to 7 years old) on the waiting list) for referral to preschool organizations; issuance of a decision to change the purpose of the land plot; provision of a land plot for the construction of an object within the boundaries of a locality; acquisition of rights to land plots that are in state ownership that do not require bidding (contests, auctions); sale to private ownership of a land plot previously granted for land use, placing on the waiting list for receiving a land plot.
The total number of bylaws that determine the procedure for providing public services to the State Institution "Office of the Akim of the Avatsky rural District" is 6.
For the period from July to December 2020, 11 public services were provided to the residents of the district: the acquisition of rights to land plots that are in state ownership, which does not require bidding (contests, auctions)-3 refused, placing on the queue for obtaining a land plot-8.
From January to March 2021, assistance was provided to the population in obtaining 274 services in electronic form through an electronic corner in the State Institution "Office of the Akim of the Avatsky Rural District".
The akim's office attracts specialists responsible for the types of activities to inform the public. The standards and regulations of service providers contain phone numbers, a stand with sample application forms. During the reporting period, there were no complaints from individuals and legal entities about public services.
In its work in the provision of public services, the office of the akim of the rural district is guided in accordance with the Law "On Public Services" of the Republic of Kazakhstan and other regulatory legal acts.
For people with disabilities, the akimat of the rural district has created the necessary conditions for unhindered access to public services.
Information about the rendered public services is provided monthly and quarterly to the organizational department of the office of the akim of the Enbekshikazakh district.
In the state institution "Office of the Akim of the Avatsky Rural District", a legal act was adopted on the approval of the responsible person for conducting internal quality control of the provision of services and persons providing relevant public services.
Suggestion: In order to strengthen responsibility and prevent violations, frequent awareness-raising activities with public service providers are carried out.
During this period, there were no applications or complaints about the provision of public services from individuals and legal entities. On the reverse side of the response form to the received applications to the office of the akim of the Avatsky rural district from individuals and legal entities, a memo on the prevention of corruption is printed.
Proposal: In order to prevent violations of the standards of public services, to hold a seminar-meeting and to increase the responsibility of civil servants
4. Risk of direct contact
In the office of the akim of the Avatsky rural district, there is a risk of direct contact with the service recipient, since some public services are provided in paper form. In this regard, a stand was made for the public as an advertisement for the provision of public services through the State Corporation, which is a single provider for the provision of public services and through the web portal "electronic government" and work is underway to increase the percentage of public services provided through the State Corporation "Government for Citizens" in comparison with the number of public services provided through the office of the akim of the rural district. The office of the akim of the Avatsky rural district is working to inform service recipients about the possibility of providing public services in electronic form (articles, information, ads in the media).
Proposal: In order to prevent the risk of direct contact with the service recipient, all public services should be provided through the State Corporation "Government for Citizens".
Other issues related to the organizational and managerial activities of the Akim's office of the Avatsky rural district.
In accordance with paragraph 1 of Article 7 of the Law of the Republic of Kazakhstan "On the procedure for considering Appeals of individuals and legal Entities", the State Institution "Office of the Akim of the Avatsky Rural District" receives, registers, registers and reviews appeals of individuals and legal entities. During the analysis in the office of the akim of the rural district for the consideration of appeals of individuals and legal entities, no violations of the law were revealed. In total, 50 applications were accepted from July to December 2020, and 0 from legal entities. Accepted orders: for personnel - 20 orders (for technical workers - 4), for the main order-38 orders. The number of solutions is 60. The number of incoming documents is 247, the number of outgoing documents is 446.
According to Article 9 of the Law of the Republic of Kazakhstan "On the procedure for considering appeals of individuals and legal entities", timely, comprehensive and objective consideration of appeals of individuals and legal entities is provided.
Suggestion: Strictly comply with the requirements of the Law of the Republic of Kazakhstan "On the procedure for considering appeals of individuals and legal entities".
On public procurement
Public procurement in the office of the district akim is carried out in electronic form. Individual entrepreneurs send invoices through the ESF portal.
In accordance with the requirements of the Law of the Republic of Kazakhstan No. 434 of December 4, 2015 - V "On Public Procurement" and in the procurement conducted, there were no violations of the requirements of the Law of the Republic of Kazakhstan "On Combating Corruption".

In the course of the implementation of the Law of the Republic of Kazakhstan "On Combating Corruption", in order to prevent violations among civil servants, it is necessary to frequently conduct appropriate measures and strengthen their responsibility.
In order to prevent the risk of direct contact with the service recipient, all public services should be provided through the State Corporation "Government for Citizens".
