About the order of employment in preschool organizations for the prevention of corruption risks

The recruitment of teachers is carried out through a competition and measurable criteria.
The status of a teacher, rights, social guarantees and restrictions, duties and responsibilities of a teacher are defined in the Law of the Republic of Kazakhstan "On the status of a teacher" dated December 27, 2019 No. 293-VI ZRK.
The Law applies, among other things, to teachers who carry out professional activities in preschool organizations.
According to Article 4 of the Law, a person has the status of a teacher during the period of professional activity in the field of education and being in labor relations with the relevant organization in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
The norm of Article 43 of the Law of the Republic of Kazakhstan "On Education" establishes that educational organizations are independent in the implementation of the educational process, selection and placement of personnel.
The list of positions of teachers in the field of preschool education was approved by the Order of the Ministry of Education and Science of the Republic of Kazakhstan dated April 15, 2020 No. 145.
NPAs that determine the procedure for hiring in preschool organizations:
Rules of appointment, dismissal of the first heads and teachers of state educational organizations (Order of the Minister of Education and Science of the Republic of Kazakhstan dated February 21, 2012 No. 57) - the procedure for appointing and dismissing the first heads of state educational organizations, the procedure for holding a competition for the position of the first head, the procedure for providing public services, the procedure for certification, the procedure for interviewing, the procedure for appointing and dismissing teachers of state educational organizations are defined.
The occupation of the position of the first head is carried out in accordance with the decision of the employer or by competition.
 Hiring of the first head is carried out by concluding an employment contract and issuing an act of the employer.
 The basis for admission is a positive conclusion of the competition commission.
The admission of teachers to work in the educational organization is carried out on the basis of the information system of the state body, in the absence of an information system - in paper format.
The competition for the vacant position of a teacher of the state educational organization is organized by the state educational organization.
Teachers who meet the Typical qualification characteristics of teachers participate in the competition.
Standard qualification characteristics of teachers' positions (Order of the Minister of Education and Science of the Republic of Kazakhstan No. 338 dated July 13, 2009) – job responsibilities and requirements for the qualification of a teacher are defined.
Standard staff of employees of state educational organizations (Resolution of the Government of the Republic of Kazakhstan dated January 30, 2008 No. 77) – defined positions, the number of staff units depending on the number of groups and per group.
The requirements of the NPA are aimed at ensuring transparency in the employment of teachers, eliminating corruption risks and high-quality selection of candidates for the position of teacher.
