In accordance with Article 6 of the Law of the Republic of Kazakhstan dated January 23, 2001 "On Local Public Administration and Self-Government in the Republic of Kazakhstan", articles 8 and 9 of the Law of the Republic of Kazakhstan dated May 25, 2020 "On the procedure for organizing and holding peaceful assemblies in the Republic of Kazakhstan", the Shalkar District Maslikhat DECIDED:
To determine specialized places for organizing and holding peaceful assemblies in the Shalkar district, the procedure for using specialized places for organizing and holding peaceful assemblies, the norms of their maximum occupancy, as well as the requirements for logistical and organizational support of specialized places for organizing and holding peaceful assemblies, according to Annex 1 to this decision.
Determine the boundaries of adjacent territories in which picketing in the Shalkarsky district is prohibited in accordance with Annex 2 to this decision.
The state institution "Apparatus of the Shalkar district Maslikhat" in accordance with the procedure established by law to provide:
1) state registration of this decision in the Department of Justice of the Aktobe region;
2) placement of this decision on the Internet resource of the maslikhat of the Shalkar district, after its official publication.
This decision shall enter into force from the date of its first official publication.

The procedure for using specialized places for organizing and holding peaceful assemblies
This procedure for the use of specialized places for organizing and holding peaceful assemblies (hereinafter referred to as the Procedure) was developed on the basis of the Law of the Republic of Kazakhstan dated May 25, 2020 "On the Procedure for Organizing and Holding Peaceful Assemblies in the Republic of Kazakhstan" and defines the procedure for using specialized places for organizing and holding peaceful assemblies (hereinafter referred to as the Law).
The organization and holding of peaceful assemblies are places of common use and are determined by the local representative body of the Shalkar district for holding peaceful assemblies.
In specialized places for peaceful assemblies, public events are held that are peaceful, nonviolent and unarmed in nature, do not pose a threat to the interests of state security, public order, health protection, protection of public morals, rights and freedoms of others.
Meetings, rallies, demonstrations, marches and picketing in violation of the current Law are prohibited in specialized places for peaceful assemblies.
When introducing a state of emergency, martial law or a legal regime of an anti-terrorist operation for the period of their validity, holding peaceful assemblies may be prohibited or restricted in accordance with the procedure established by the Laws of the Republic of Kazakhstan "On the state of Emergency", "On martial law" and "On Countering terrorism".
Peaceful assemblies in specialized places may not begin earlier than 9 o'clock and end later than 20 o'clock local time on the day of peaceful assemblies.
The relations not regulated by this Procedure are regulated in accordance with the current legislation of the Republic of Kazakhstan.
Appendix 2 to the decision of the Shalkar District Maslikhat No. 524 dated September 10, 2020
Borders of adjacent territories in which picketing is prohibited in the Shalkarsky district
Determine the following boundaries of adjacent territories in which picketing is prohibited:
1) in places of mass graves;
2) borders of adjacent territories to objects of railway, water, air and road transport – 100 meters;
3) the borders of adjacent territories to organizations that ensure the defense capability, security of the state and the vital activity of the population – 400 meters;
4) the boundaries of adjacent territories to hazardous production facilities and other facilities, the operation of which requires compliance with special safety regulations - 100 meters;
5) the borders of adjacent territories to the main railway networks, main pipelines, the national electric network, main communication lines – 100 meters.
