This order comes into effect from 01.01.2016.
In accordance with subparagraph 33) of article 16 of the Labor Code of the Republic of Kazakhstan dated November 23, 2015, I ORDER:
1. To approve the attached Rules for the issuance of milk or equivalent food products, therapeutic and prophylactic food, special clothing and other personal protective equipment to workers, providing them with collective protective equipment, sanitary facilities and devices at the expense of the employer.
2. The Department of Labor and Social Partnership of the Ministry of Health and Social Development of the Republic of Kazakhstan, in the manner prescribed by law, shall ensure:
1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, the direction for official publication in periodicals and the information and legal system "Adilet";
3) posting this order on the Internet resource of the Ministry of Health and Social Development of the Republic of Kazakhstan;
4) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, the submission to the Department of Legal Service of the Ministry of Health and Social Development of the Republic of Kazakhstan information on the implementation of the measures provided for in subparagraphs 1), 2) and 3) of this paragraph.
3. Control over the implementation of this order shall be entrusted to the Vice-Minister of Health and Social Development of the Republic of Kazakhstan, Nurymbetov BB.
4. This order comes into force on January 1, 2016 and is subject to official publication.

1. General Provisions
1. These Rules for the issuance of milk or equivalent food products, therapeutic and prophylactic food, special clothing and other personal protective equipment to workers, providing them with collective protective equipment, sanitary facilities and devices at the expense of the employer (hereinafter referred to as the Rules) are developed in accordance with subparagraph 33) of Article 16 of the Labor Code of the Republic of Kazakhstan dated November 23, 2015 (hereinafter referred to as the Labor Code) and establish the procedure for issuing milk or equivalent food products, therapeutic and prophylactic food, special clothing and other personal protective equipment to workers, providing them with collective protective equipment, sanitary facilities and devices at the expense of the employer.
2. Milk or equivalent food products (hereinafter referred to as milk), therapeutic and prophylactic nutrition (hereinafter referred to as PPI), special clothing, personal protective equipment shall be issued in accordance with the norms approved in accordance with subparagraphs 34) and 35) of Article 16 of the Labor Code ( hereinafter referred to as the Norms).
3. Basic concepts used in these Rules:
1) special clothing - clothing, footwear, headwear, mittens, other personal protective equipment designed to protect the employee from harmful and (or) hazardous production factors;
2) personal protective equipment - means designed to protect an employee from exposure to harmful and (or) hazardous production factors, including special clothing;
3) production equipment - machines, mechanisms, devices, apparatus, instruments and other technical means necessary for work, production;
4) collective protective equipment - technical means designed to simultaneously protect two or more workers from the effects of harmful and (or) hazardous production factors.
2. The procedure for issuing milk or equivalent food to workers

4. Milk and medicinal products are issued to employees based on the results of certification of production facilities for working conditions, in order to prevent occupational diseases and poisoning, and to improve the health of employees.
5. Replacement of milk with other equivalent food products, and (or) specialized products for dietary (therapeutic and prophylactic) nutrition is allowed with the consent of the employee, and is formalized by the decision of the collective agreement or the act of the employer.
6. Milk is issued per shift (during a break), regardless of its duration on the days of actual employment of the employee in work related to the production or use of chemicals, according to the Standards.
