On January 7, 2020, the Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on housing and Communal services"came into force.
Within the framework of the adopted Law, only two forms of management are provided for:
The Association of Property Owners (OSI) is a legal entity that is a non-profit organization formed by the owners of apartments, non-residential premises of one MZhD, which manages the condominium object, finances its maintenance and ensures its safety, which will work on the principle of "one house – one AXIS – one account".
A simple partnership (PT) – without the formation of a legal entity, which will work on the principle of "one house – one PT – one account".
In the MZhD, located on a single foundation or having a single common house engineering systems, the owners of apartments, non-residential premises have the right to create one OS or PT with the consent of more than 2/3 of the owners of apartments, non-residential premises of each multi-apartment residential building.
The total number of multi-storey residential buildings in the Aktobe region is 2,526 units. In total, 2,301 MZhD are subject to the transition to new forms. Meetings to explain innovations in housing legislation are held on a daily basis.
For reference: 225 are not subject to transfer, including: 60-in communal ownership, 24 - in an emergency condition, 118-the number of owners does not allow creating a new form, 23 – there are no general engineering communications.
To date, the region has created
55 associations of property owners, 492 simple partnerships (547 new forms in total).
KSP(K), PKSP( K), PK can carry out their activities until July 1, 2022.
After the expiration of the validity period of the KSP( K), the PKSP (K), the PC must, according to the act, transfer to the Council of the Ministry of Railways all available technical, financial and other documents and liquidate in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
