Analytical report on the internal analysis of corruption risks in the activities of the State Institution "Office of the Akim of the Astana district of the city of Aktobe"

In the period from May to November 5, 2021, an internal analysis of corruption risks was carried out on the basis of the order of the akim of the district No. 207 dated November 5, 2021 "On conducting an internal analysis of corruption risks in activities.
According to the approved rule of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption No. 12 dated October 19, 2016 , internal analysis of corruption risks is carried out in the following areas:
1) identification of corruption risks in regulatory legal acts affecting the activities of the unit;
2) identification of corruption risks in the organizational and managerial activities of the unit.
1. Regulatory legal acts affecting the activities of the State Institution "Office of the Akim of the Astana district of the city of Aktobe":
- Law No. 416-V of November 23, 2015 "On the Civil Service of the Republic of Kazakhstan"
- Law of the Republic of Kazakhstan dated January 23, 2001 No. 148 "On Local State administration and self-government in the Republic of Kazakhstan";
- The Code of the ZRK "Administrative Procedural Code" of the
Republic of Kazakhstan dated June 29, 2020 No. 350-VI
- Budget Code of the Republic of Kazakhstan No. 95-IV dated December 4, 2008
- Law of the Republic of Kazakhstan dated December 4, 2015 No. 434-V "On Public procurement";
2. Identification of corruption risks in the organizational and managerial activities of the unit.
1) Personnel management, including staff turnover.
The staffing of the State Institution "The Office of the Akim of the Astana district of Aktobe" is 22 units and 2 vacancies (in connection with the care of the child of the main employee and in connection with pregnancy and childbirth)
In connection with the occupation of another public position, 2 civil servants were dismissed, 2 employees were appointed to senior positions.
In accordance with the Decree of the President of the Republic of Kazakhstan dated July 28, 2021 No. 633 "On some issues of optimizing the staffing limits of state bodies and quasi-public sector entities", Resolution of the Akimat of Aktobe dated September 27, 2021 No. 5500 "On Amendments to the Resolution of the Akimat of Aktobe dated July 7, 2020 No. 2700", paragraph 4 of Article 56 of the Law of the Republic of Kazakhstan dated November 23, 2015 No. 416-V, In accordance with subparagraph 2 of paragraph 1 of Article 52 of the Labor Code of the Republic of Kazakhstan dated November 23, 2015 No. 414-V, the positions of 1 chief specialist and 1 vacancy were reduced . Compensation for the reduction has been paid in full. 2 specialists have been appointed to the proposed positions.
In accordance with Article 14 of the Law of the Republic of Kazakhstan No. 410-V ZRK "On Combating Corruption" dated November 18, 2015, no close family relations were revealed during the analysis between the employees of the State Institution "Office of the Akim of the Astana district".
2) Conflict of interest settlement
In accordance with Article 15 of the Law of the Republic of Kazakhstan dated November 18, 2015 No. 410-V ZRK "On combating Corruption", no conflict of interest was revealed. There were no complaints from government employees.
3) The State Institution "The Office of the Akim of the Astana district of the city of Aktobe" does not provide public services and does not implement licensing functions.
4) There are no negative publications in the mass media.
Advertisements and informational publications are placed in the mass media. No negative information has been identified.
Akimat of the district has a separate page of akim and akimat of the district in the social networks "Instagram" and "Facebook". Information messages, reports on the work done, on the reception of citizens, on state programs are published daily.
The received questions on social networks (comments, direct) were answered in a timely manner on a motivated basis.
5) Receipt of applications from individuals and legal entities.
GU "Office of the Akim of the Astana district of Aktobe" in total, 231 appeals from legal entities and individuals were received and registered during the monitoring period. Of them: from legal entities - 26, from individuals - 164, at the personal reception of the akim - 41 people.
Satisfied - 2 appeals, explained in writing and orally - 138 appeals, sent to other institutions - 55 appeals.
Registered: 2690 incoming emails, 1306 outgoing emails.
All appeals were considered on time, no overdue appeals were revealed.
6) Results of acts of prosecutorial and judicial supervision
In accordance with the individual definitions of the specialized interdistrict Economic Court of Aktobe region No. 1513-21-00-2/1014 dated June 22, 2021 and No. 1513-21-00-2/1021 dated June 25, No. 1513-21-00-2/1017 dated June 30, by order of the Akim of the Astana district of Aktobe city No. 128 dated July 14 of this year regarding the chief specialist of the organizational and control department of the State Institution "Apparatus of the Akim of the Astana district of Aktobe city" Kutynova Z. An official investigation was conducted, a warning about incomplete official compliance was issued in fact.
Conclusion
During the internal analysis of corruption risks in organizational and managerial activities, regulatory legal acts affecting the activities of the State Institution "Office of the Akim of the Astana district of the city of Aktobe", no risks contributing to the commission of corruption offenses were identified.
