CHAPTER I. GENERAL PROVISIONS


1. The state Institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is a state body of the Republic of Kazakhstan that provides guidance for the implementation of state policy in the field of entrepreneurship, agriculture and tourism development in the Tupkragan district.
2. The State institution "Tupkaragan District Department of Entrepreneurship and Agriculture" carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan and laws in the field of entrepreneurship and agriculture, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
3. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the treasury bodies.
4. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" enters into civil relations on its own behalf.
5. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation.
6. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" on issues of its competence, in accordance with the procedure established by law, makes decisions issued by orders of the head of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" and other acts provided for by the legislation of the Republic of Kazakhstan.
7. The structure and the limit of the staffing of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" are approved in accordance with the current legislation.
8. Location of the legal entity: index 130500, Republic of Kazakhstan, Mangystau region, Tupkaragan district, Fort Shevchenko city, N.Onalbayuly Street, building No. 2.

9. Full name of the state body:

in Russian: State institution "Tupkaragan District Department of Entrepreneurship and Agriculture"
10. This Regulation is the constituent document of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture".
11. Financing of the activities of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is carried out from the local budget.
12. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture".
13. If the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is granted the right by legislative acts to carry out income-generating activities, then the income received from such activities is directed to the state budget income.

Chapter II. Mission, main tasks, functions, rights and obligations of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture"

14. The mission of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture":
These are ensuring state support in the district and creating the most favorable conditions for the development of entrepreneurship, expanding the infrastructure of entrepreneurship and its promotion, ensuring pricing in the food market.
15. Tasks:
1) creation of the most favorable conditions for the development of entrepreneurship;
2) carries out measures to provide interested parties with temporary retail outlets of areas (sites) for the sale of fruit and vegetable products and melon crops of a seasonal nature on the territory of the district;
3) organizes participation in various republican, regional and district events concerning business entities of the district;
4) performing other tasks assigned by the legislation.
5) ensuring the implementation of state programs on attracting investment and industrial development;
6) creation of favorable conditions for the development of priority sectors of the district's economy;
7) providing conditions for the development of new competitive industries;
8) provision of state support for entrepreneurship and rural – economic services;
9) implementation of state technical inspection in the field of agro-industrial complex.
10) ensuring the implementation of tourism policy, increasing tourist attractiveness in the Tupkaragan district;
11) ensuring the implementation of state programs in the field of tourism;
12) development of the regional cultural and tourist cluster and ensuring further development of the tourist infrastructure of the region;
13) increasing the contribution of the tourism industry to the economy of the district.
16. Functions:

  1. implementation of state programs to support entrepreneurship, agriculture and tourism in the district, monitor the development of small and medium-sized businesses;
    2. registration of permits for the trade of seasonal fruit and vegetable products and conducts explanatory work with citizens engaged in trade in unidentified places in the district;
    3. monitoring of prices for socially important goods of the district and implementation of price stabilization policy;
    4. organizes exhibitions and fairs;
    5. provides assistance to entrepreneurs of the district in the field of state support with financial organizations (banks, microorganisms, foundations, etc.);
    6. develops measures to create conditions conducive to the development of entrepreneurial activity in the district;
    7.coordination of the activities of the expert council on entrepreneurship under the Akimat;
    8. assistance in organizing events (forums, exhibitions, seminars, meetings, etc.) on attracting investments, developing local content industry;
    9. collecting, analyzing and providing information on investment projects to the regional executive body in the field of state support of industrial and innovative activities;
    10. analysis of the current state of attracting investment in the economy of the district;
    11. participation in the development and implementation of the annual action plan to attract investment in the Tupkaragan district;
    12. assistance in organizing events (forums, exhibitions, seminars, meetings, etc.) on the development of tourism activities;
    13. implementation of state policy and coordination in the field of tourism activities in the district;
    14. contributing to the growth of the number of internal and incoming visitors and their average consumption in the area;
    15. organize education, training, retraining and advanced training of specialists and personnel for small businesses;
    16.ensure the implementation of trade policy;

    18. In accordance with the current legislation of the Republic of Kazakhstan:

Registers and issues certificates of state registration of the pledge of tractors and self-propelled chassis and mechanisms made on their basis, trailers to them, including trailers with mounted special equipment, self-propelled agricultural, reclamation and road-building machines and mechanisms, as well as special cross-country vehicles;
    Issues certificates for the right to drive tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road construction machines and mechanisms, as well as special cross-country vehicles;
    Registers, re-registers tractors and self-propelled chassis and mechanisms made on their basis, trailers to them, including trailers with mounted special equipment, self-propelled agricultural, reclamation and road-building machines and mechanisms, as well as special cross-country vehicles with the issuance of registration plates;
    To conduct an annual state technical inspection of tractors and self-propelled chassis and mechanisms made on their basis, trailers to them, including trailers with mounted special equipment, self-propelled agricultural, reclamation and road-building machines and mechanisms, as well as special cross-country vehicles;
    19. Considers methods for developing the level of infrastructure provision for enterprises engaged in agriculture, sends proposals to the competent authorities;
    20. Analyzes in detail the concepts of creating a belt of agricultural products, holding seminars, together with agricultural producers;
    21. Within its competence, organizes work on subsidizing agricultural producers from the local budget, in accordance with the rules and regulations approved by the resolutions of the Government of the Republic of Kazakhstan;
    22).Forms an anti-corruption culture;
    23. Registration of the census and breeding animals, provision of advisory assistance in the timely formation and submission of documents of recipients of subsidies allocated from the Republican and local budgets.
    24. Promotes the organization of the work of bakeries, fish farms and occupied farms.
    25. Forms and promptly sends to the regional Department of agriculture documents for subsidies provided to farmers by special resolutions of the Government of the Republic of Kazakhstan.
    26. At the end of the year, summarizes the results of work in the field of agriculture, prepares materials for the annual report of the akim of the district, forms a board of indicators.
    27. Monitoring the timely submission of reports by institutions that submit statistical reports on a monthly basis, providing information on the results of the IFO (physical volume index).
    28. Keeping records of breeding stock in farms engaged in livestock breeding within the district, submission of the annual report of the district provided for by the standard.
    29. Takes appropriate measures to digitalize the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture".
    30.The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" also performs other functions provided for by the legislation of the Republic of Kazakhstan.
    17. Rights and obligations:

    Implementation of state control over compliance with the size of the maximum permissible retail prices for socially significant food products, consideration of cases of administrative offenses concerning exceeding the size of the maximum permissible retail prices for socially significant food products, trade in unspecified places, control over the size of the trade allowance for socially significant food products, grant the right to conduct an inspection, checks the safety and use of property transferred to the balance of the department.
    Exercises other powers assigned by the legislation of the Republic of Kazastan.


    Chapter III. Organization of the activities of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture"

    18. The management of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is carried out by the first head, who is personally responsible for the fulfillment of the tasks assigned to the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" and the exercise of their functions.
    19. The first head of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture" is appointed and dismissed from the post of akim of the Tupkaragan district.
    20. The powers of the first head of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture"
    1) distributes and approves job responsibilities among employees and the degree of their responsibility;
    2) in accordance with the Law, appoints and dismisses employees of the department;
    3) issues orders and gives instructions that are mandatory for all employees of the department;
    4) acts on his behalf without a power of attorney in relations with state bodies, organizations and citizens;
    5) approves the staffing table of the department within the established wage fund and the number of employees;
    6) in accordance with the procedure established by law, resolves issues of remuneration, provision of financial assistance, bringing employees of the department to disciplinary responsibility;
    7) takes measures to combat corruption and is personally responsible for it;
    8) sign contracts, issue power of attorney, open bank accounts and make other transactions;
    9) ensures the safety of the transferred communal property;
    10) conducts a personal reception of citizens and representatives of legal entities;
    11) other issues of the organization of the activities of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture", the rights and obligations of employees are established by the regulations of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture" approved in accordance with the established procedure.
    12) The execution of the powers of the first head of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" during his absence is carried out by the person replacing him in accordance with the current legislation.


    Chapter IV. Property of the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture"

    21. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" may have a separate property on the right of operational management in cases provided for by law.
    The property of the State Institution "Tupkaragan District Department of Entrepreneurship and Agriculture" is formed at the expense of the property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
    22. The property assigned to the state institution "Tupkaragan district Department of Entrepreneurship and Agriculture" belongs to the communal property.
    23. The state institution "Tupkaragan District Department of Entrepreneurship and Agriculture" has no right to independently alienate or otherwise dispose of the property assigned to it, and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.

    Chapter V. Reorganization and abolition of the state institution "Tupkaragan District Department of Entrepreneurship and Agriculture"

    24. Reorganization and abolition of the State Institution "Tupkaragan District Department of Entrepreneurship and Agriculture" are carried out in accordance with the legislation of the Republic of Kazakhstan.
