CHANGES IN STATE REGISTRATION!
Last November, the Law of the Republic of Kazakhstan was adopted"On amendments and additions to some legislative acts of the Republic of Kazakhstan on the implementation of the Address of the Head of State dated March 16, 2022".
The law has amended a number of legislative acts, including the Law "On Legal Acts".In particular, as part of the optimization of the state registration procedure from among those subject to state registration: - On the approval or clarification of local budgets;
-in cases stipulated by legislation in the field of veterinary medicine, providing for the adoption of decisions on the establishment (liquidation) of a quarantine zone with the introduction of a quarantine regime in the relevant territory, on the establishment (cancellation) of quarantine and (or) restrictive measures, as well as on the declaration of a natural and man-made emergency;
- the regulatory legal acts on the approval of the maximum values of retail prices for socially significant food products and the size of the maximum allowable retail prices (hereinafter referred to as the NPA) are excluded.
These changes are aimed at accelerating the implementation of measures provided for in the budget, as well as at preventing the occurrence and spread of diseases that pose a danger to the health of the population and animals, preventing and eliminating natural and man-made emergencies, and immediately taking measures related to the stabilization of prices for socially important food products.
Nevertheless, when adopting such acts, such requirements remain as the placement of the developed draft NPA on the Open NPA portal, obtaining expert opinions of members of the National Chamber of Entrepreneurs of the Republic of Kazakhstan and the Expert Council, anti-corruption expertise, recommendations of the Public Council, as well as publication in the Reference Control Bank of the NPA NPA akr, except in cases provided for by law.
In addition, in accordance with the Decree of the Government of the Republic of Kazakhstan dated December 29, 2022 No. 1093 "on amendments to certain decisions of the Government of the Republic of Kazakhstan", the functions of the Ministry of Justice for the implementation of state registration of local government bodies.since January 1, it has been transferred to the territorial bodies of justice.
Summing up, we note that the changes make it possible to optimize the procedure for state registration of regulatory legal acts.
