In order to prevent corruption and identify the factors of corruption, the Head of State clearly stated the need to analyze the normative acts of state bodies from the perspective of anti-corruption fight in the Address "Kazakhstan in the new situation: the period of action".
In this regard, the Law of the Republic of Kazakhstan "On Legal Acts" was supplemented with the norm that drafts of regulatory legal acts must be subject to mandatory anti-corruption scientific expertise (hereinafter - scientific expertise).
In addition, the principles of conducting anti-corruption scientific examination of drafts of regulatory legal acts, which clearly define the procedure for conducting an examination of regulatory legal acts (hereinafter - the rules of conducting scientific examination of anti-corruption) / Resolution No. 451 of the Government of the Kyrgyz Republic of July 16, 2020/ came into force.
The purpose of the scientific examination is to determine the norms of corruption, to develop recommendations aimed at their elimination.
From this time until they are sent for state registration, drafts of normative legal acts of maslikhats, akimats, akims and inspection commissions are sent to the justice body for approval with the conclusion of scientific expertise.
Currently, the scientific expertise is carried out by the Academy of Public Administration under the President of the Republic of Kazakhstan (Coordinator).
The developing bodies send drafts of regulatory legal acts to the Coordinator's address through the unified cloud document circulation system for conducting scientific expertise.
The list of documents to be sent to the Coordinator by the developing body for examination, as well as the list of normative legal acts, which are not subject to examination, is clearly defined in the rules of scientific examination against corruption /clauses 21, 5 of the rule/.
The term of the examination shall not exceed 10 working days from the date of submission to the Coordinator of draft normative legal acts and related documents.
Thus, before the state registration, the normative legal acts developed and adopted by the local state bodies must contain the conclusion of the anti-corruption scientific expertise!
In short, I believe that conducting a scientific examination is the main guarantee of preventing corruption!
