Chapter I. General provisions

 

1. The state institution" munaily District Department of entrepreneurship and agriculture " is a state body of the Republic of Kazakhstan that manages the implementation of the state policy for the development of entrepreneurship and agriculture in Munaily district.
2. The state institution" munaili District Department of entrepreneurship and agriculture " carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan in the field of entrepreneurship, acts of the president and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as these regulations.
3. The state institution" munaily District Department of entrepreneurship and agriculture " is a legal entity of organizational and legal form, has a seal and stamps with its name in the state language, forms of the established sample, as well as accounts with the Treasury bodies in accordance with the legislation of the Republic of Kazakhstan.
4. The state institution" munaili District Department of entrepreneurship and agriculture " enters into civil relations on its own behalf.
5. The state institution" munaili District Department of entrepreneurship and agriculture " has the right to act as a party to civil relations on behalf of the state, if it is authorized to do so in accordance with the legislation.
6. The state institution" munaily District Department of entrepreneurship and agriculture "makes decisions on issues of its competence in accordance with the procedure established by law, which are formalized by orders of the head of the state institution" Munaily District Department of entrepreneurship and agriculture " and other acts provided for by the legislation of the Republic of Kazakhstan.
7. The structure and staffing limit of the state institution" munaili District Department of entrepreneurship and agriculture " are approved in accordance with the current legislation.

10. This regulation is a constituent document of the state institution" Munaili District Department of entrepreneurship and agriculture".
11. Financing of the activities of the state institution" munaili District Department of entrepreneurship and agriculture " is carried out from the local budget.
12. The state institution" munaily District Department of entrepreneurship and agriculture "is prohibited from entering into contractual relations with business entities in the context of performing tasks that are functions of the state institution" Munaily District Department of entrepreneurship and agriculture".
13. If the state institution" Munaily District Department of entrepreneurship and agriculture " is granted the right by legislative acts to carry out income-generating activities, then the income received from such activities is sent to the state budget revenue, unless otherwise established by law.

 

Chapter II. Mission, main tasks, functions, rights and obligations of the state institution" munaili District Department of entrepreneurship and agriculture"

 

14. Mission of the state institution" munaili District Department of entrepreneurship and agriculture":

Ensuring state support for entrepreneurship in the district, creating the most favorable conditions for the development of entrepreneurship, expanding and promoting the infrastructure of entrepreneurship, ensuring price stability in trade markets and state policy in the field of Agriculture and tourism.

15. Responsibilities:

1) creating the most favorable conditions for the development of entrepreneurship;

2) implementation of measures for persons interested in the seasonal opening of temporary points of sale, sites (sites) selling garden products on the territory of the district;

3) Organization of participation of the district in various Republican, regional and district events related to business entities;       

4) Ensuring the implementation of investment policy in munaili district, increasing investment attractiveness, development of industry and local content;

5) ensuring the implementation of state programs on attracting investment and industrial development;

6) creating favorable conditions for the development of priority sectors of the district's economy;

7) providing conditions for the development of new competitive industries.

8) providing state support for entrepreneurship and agricultural activities;

9) implementation of State technical inspection in the field of agro-industrial complex;

10) ensuring the implementation of tourist policy, increasing tourist attractiveness, name of the city or district ;

11) ensuring the implementation of state programs in the field of tourism activities;

12) development of the regional cultural and tourist cluster and ensuring the further development of the tourist infrastructure of the region;

13)  increasing the share of the tourism industry in the economy of the district.

16. Functions:

• implementation of state programs related to entrepreneurship, agricultural tourism, development of small and medium-sized businesses in the district;
• registration of permits for the sale of vegetable and vegetable products during the seasonal period and carrying out warning and explanatory work on the shortcomings of persons who traded in places not specified on the territory of the district;
• monitoring prices for socially important goods in the district and implementing price stabilization policies;
• Organization of exhibitions and fairs;
• providing assistance to entrepreneurs of the district on state support in cooperation with financial organizations (banks, micro-organizations, funds, etc.);
• development of measures to create favorable conditions for the development of entrepreneurial and agricultural activities in the district;
• coordination of the activities of the Expert Council on entrepreneurship under the district akimat;
• providing assistance to subjects of industrial and innovative activity, industrial enterprises in solving administrative issues within their competence;
• assistance in determining the need for personnel in implemented projects and existing enterprises of the manufacturing industry;
• assistance in organizing events (forums, exhibitions, seminars, meetings, etc.) on attracting investment, developing industry and local content;
• collection, analysis of information on investment projects and submission to the regional executive body in the field of state support for industrial and innovative activities;
• assistance in organizing the work of the Regional Investment Council to analyze problematic issues and barriers that hinder the attraction of investments, the implementation of investment projects;
• making proposals for the development of specific areas of economic sectors, including the industrial sector of the economy;
• analysis of the current state of attracting investment in the economy of the district;
• identification of projects requiring investment for potential investors and ensuring the preparation of relevant documents;
• Participation in the development and implementation of the annual action plan to attract investment in munaili district;
• participation in the development and implementation of state programs, district development programs in terms of the development of industry, including the manufacturing industry;
• analysis of the current state of industry and manufacturing and forecast of economic indicators;
• assistance in organizing events (forums, exhibitions, seminars, meetings, etc.);
• implementation and coordination of the state policy in the field of tourism activities in the district;
• promotion of attracting investment in the tourism sector in the district;
• conducting negotiations and searching with potential investors, entrepreneurs in order to attract them to participate in the implementation of tourist projects in the district;
• formation of an electronic database of all tourism projects in the district;
• creating conditions for cooperation between districts of the tourism business;
• keeping records of all tourists on the territory of the district, including hotels and natural objects;
• annual inventory of tourism facilities, creation and updating of the electronic database of objects specified in the district;
• conducting an analysis of the tourism services market and providing the management body with the necessary data on the development of tourism in the district;
• development and implementation of measures to protect district tourist resources;
• participation in the work on planning and construction of tourist industry facilities in the district;
• providing methodological and advisory assistance to subjects of tourist activity in matters related to the organization of tourist activities;
• develops an action plan for the development of the tourism industry in agreement with the management body;
• exercise in the interests of local public administration other powers assigned to the state institution of the district by the legislation of the Republic of Kazakhstan.
• monitoring of macroeconomic indicators of the agricultural sector in the district, collecting information on the work of livestock and crop producers, conducting forecasts and analyzes;
• carrying out work on ensuring the implementation of measures for the agro-industrial complex, the introduction of advanced technologies and techniques in agriculture, the effective use of agricultural land, the development of new pasture, hay and arable land, their irrigation, feed and water supply.
• ensuring high-quality and timely provision of public services assigned to the department in the field of agriculture, maintaining and submitting reports on this. Implementation of other tasks that are in the interests of local government bodies.
• control over the quality of public services rendered by the department and timely submission of annual and monthly reports on public services performed;
• implementation of the policy on tractors and their attachments, including self-propelled chassis and mechanisms made on their basis, trailers with mounted special equipment, self-propelled agricultural, reclamation and road construction machines and mechanisms, as well as special machines with high cross-country ability;
• control over accounting collections, analysis of submitted reports and their totals, submission to the necessary authorities and control over the development of local budget programs, full development of planned funds;

17. Rights and obligations:

1) it has the right to request and receive the necessary information from state bodies, legal entities and other organizations with the participation of the state within its competence;

2) participation in the preparation of draft resolutions of the district akimat and decisions of the maslikhat on issues falling within the competence of the Department;

3) Exercise other rights and obligations in accordance with the laws of the Republic of Kazakhstan.

 

Chapter III. Organization of activities of the state institution" munaili District Department of entrepreneurship and agriculture"

18. State institution" munaily District Department of entrepreneurship and agriculture "the first head of the management is personally responsible for the implementation of the tasks assigned to the state institution" Munaily District Department of entrepreneurship and agriculture " and the implementation of its functions.
19. The first head of the state institution" munaily District Department of entrepreneurship and agriculture " is appointed and dismissed by the Akim of Munaily district.
20. Powers of the first head of the state institution" munaili District Department of entrepreneurship and agriculture":

1) establishes the powers and responsibilities of the Department's specialists;

2) appoints and dismisses employees of the department in accordance with the legislation;

3) issues an order and gives an appropriate order to all employees of the Department;

4) Acts on behalf of the institution without a power of attorney;

5) approves the staffing table within the established limits of the number of employees and the remuneration fund of the Department;

6) solves the issue of remuneration, financial assistance, and disciplinary penalties for employees of the department in accordance with the procedure established by law;

7) takes measures to combat corruption and is personally responsible for it;

8) concludes contracts, issues powers of attorney, opens bank accounts and other transactions;

9) Other issues of organizing the activities of the state institution" munaily District Department of entrepreneurship and agriculture", the rights and obligations of employees, are determined by the regulations of the work of the state institution" Munaily District Department of entrepreneurship and agriculture".

10) During the absence of the first head of the state institution" munaily District Department of entrepreneurship and Agriculture", his powers are performed by a person who replaces him in accordance with the current legislation.

 

 

Chapter IV. Property of the state institution" munaili District Department of entrepreneurship and agriculture"

 

21. The state institution" munaily District Department of entrepreneurship and agriculture " may have separate property on the right of operational management in cases stipulated by law.

          The property of the state institution" munaily District Department of entrepreneurship and agriculture " is formed at the expense of property transferred to it by the owner, as well as property acquired as a result of its activities (including cash income) and other sources not prohibited by the legislation of the Republic of Kazakhstan.

22. The property assigned to the state institution" munaili District Department of entrepreneurship and agriculture " belongs to municipal property.

The state institution "Munaily District Department of entrepreneurship and agriculture" does not have the right to independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of the funds allocated to it under the financing plan, unless otherwise provided by law.

Chapter V. Reorganization and liquidation of the state institution" munaili District Department of entrepreneurship and agriculture"

24. Reorganization and liquidation of the state institution" munaili District Department of entrepreneurship and agriculture " is carried out in accordance with the legislation of the Republic of Kazakhstan.
