On Amendments to the resolution of the Akimat of Zhanaozen dated March 3, 2022 No. 98 "On Approval of the Rules for organizing and carrying out activities for the current or major repairs of facades, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen"
The Akimat of the city of Zhanaozen DECIDES:
1. To make the following changes to the resolution of the Akimat of the city of Zhanaozen dated March 3, 2022 No. 98 "On approval of the Rules for organizing and carrying out activities for the current or major repairs of facades, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen" (registered in the Register of State Registration of Normative Legal Acts No. 27330):
The title of the said resolution should be stated in a new version:
"On approval of the Rules for the organization and conduct of measures for the reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen."
Paragraph 1 should be reworded:
"1. To approve the attached Rules for the organization and conduct of measures for the reconstruction, maintenance or overhaul of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen.";
in the Rules for the organization and conduct of measures for the reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen, approved by the said resolution:
Paragraph 1 should be reworded:
«1. These Rules for the organization and conduct of measures for the reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen (hereinafter - The rules) were developed in accordance with subparagraph 11) of paragraph 2 of Article 10-3 of the Law of the Republic of Kazakhstan "On Housing Relations" by other regulatory legal acts and determine the procedure for organizing and carrying out measures for reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen.";
the title of chapter 2 should be stated in a new version:
"Chapter 2. The procedure for organizing measures for the reconstruction, maintenance or overhaul of exterior walls, roofs of apartment buildings";
paragraph 3 should be reworded:
"3. The State Institution "Zhanaozen city Department of Housing and Communal Services and Housing Inspection" (hereinafter referred to as the Department) defines a list of apartment buildings requiring reconstruction, current or major repairs of exterior walls, roofs to give the city a unified architectural appearance.";
subparagraph 3) paragraph 5 should be reworded:
"3) organization and holding of a meeting of owners of apartments, non-residential premises (if any) to make a decision on the consent or disagreement of measures for reconstruction, repair of exterior walls, roof of an apartment building.";
paragraphs 7 and 8 should be redefined:
"7. In the event of a negative decision by the meeting of the work There are no repairs to the exterior walls, the roof of an apartment building, or reconstruction activities aimed at giving a unified architectural appearance.
8. When the meeting makes a positive decision, the Department, in accordance with the requirements of building regulations, organizes a survey of the technical condition of the exterior walls, the roof of each apartment building to determine the scope of work, carry out reconstruction activities, type of repair (current or capital) and establish the degree of their physical wear.";
the title of chapter 3 should be set out in a new editorial offices:
"Chapter 3. The procedure for carrying out measures for the reconstruction, maintenance or overhaul of exterior walls, roofs of apartment buildings";
Paragraphs 9, 10, 11, 12, 13 and 14 should be amended:
"9. The choice of an organization for the inspection of the technical condition of the exterior walls, the roof of each apartment building to determine the scope of work, reconstruction, type of repair (current or capital) is carried out in accordance with the legislation on public procurement.
10. Based on the results of a survey of the technical condition of the exterior walls and roof of an apartment building, the Department organizes work on the development of an estimate for reconstruction, current repairs or production of design estimates for major repairs of exterior walls, roofs, aimed at giving a unified architectural appearance, followed by obtaining an expert opinion at the expense of the local budget.
11. After receiving a positive expert opinion and approving the estimated cost of current repairs or design estimates for reconstruction, major repairs of exterior walls, roofs of apartment buildings, the Department draws up a budget application in accordance with the procedure determined by the central authorized body for budget planning.
12. The purchase of works on reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance is carried out by the Department in accordance with the legislation on public procurement.
13. Acceptance of works on reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance is carried out by the Department with the involvement of persons carrying out technical supervision.
14. Financing of reconstruction, current or major repairs of exterior walls, roofs of apartment buildings aimed at giving a unified architectural appearance to the city of Zhanaozen is carried out from the local budget.
2. This resolution shall enter into force upon the expiration of ten calendar days after the date of its first official publication.
