About the approval of the Regulations of the commission on the provision of trading places for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages
In accordance with the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan", Resolution of the Government of the Republic of Kazakhstan dated November 4, 2021 No. 784 "On approval of the Comprehensive Plan of Socio-economic Development of the Mangystau region for 2021-2025 and recognition of some decisions of the Government of the Republic of Kazakhstan as invalid" and the decision of the Mangystau regional Maslikhat Dated January 15, 2021 No. 1/11 "On the development program of the Mangystau region for 2021-2025", the Akimat of the city DECIDES:
- To approve the rules for the provision of trading places for the construction and placement of business facilities (a complex of a stop trading place) in the places of the largest population concentration on the territory of the city of Zhanaozen and adjacent villages in accordance with the annex to this resolution.
- To assign control over the execution of this resolution to the deputy akim of the city of Zh. Kaynarbayev.

Rules for the provision of trading places for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages
Chapter 1. General provisions
- These Rules on the provision of trading places for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages (hereinafter referred to as the Rules) have been developed in accordance with the Law of the Republic of Kazakhstan "On Local Government and Self-Government in the Republic of Kazakhstan", the decree of the Government of the Republic of Kazakhstan dated November 4, 2021 No. 784 "On approval of the Comprehensive Plan of Socio-economic development of the Mangystau region for 2021 - 2025 and the invalidation of certain decisions of the Government of the Republic of Kazakhstan" and the decision of the Mangystau regional Maslikhat dated January 15, 2021 No. 1/11 "On the development program of the Mangystau region for 2021-2025" and defines the procedure for the provision of trading places for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages.
- The Commission in its activities is guided by the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, as well as regulatory legal acts of the Republic of Kazakhstan regulating land relations.
Chapter 2. The procedure for providing trading places for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages
- Provision of trading places for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages consists of two stages:
1) applications of business entities for obtaining land are considered by the commission for the provision of trading places for the construction and placement of business objects in the places of the largest concentration of population (a complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages (hereinafter referred to as the Commission) and the approved projects are sent for consideration to the land commission.
2) Applications (applications) for projects approved by the commission are considered by the land commission and conclusions are prepared.
- The Commission for the provision of trading places for the construction and placement of business objects in the places of the largest concentration of the population (the complex of a stopping trading place) on the territory of the city of Zhanaozen and adjacent villages is a temporary body that preliminarily considers in economic terms and selects the applications received for the acquisition of trading places for the construction and placement of business objects (the complex a stopping place for shopping) .
The Land Commission is the body that makes decisions on selected applications for granting the right to use a land plot.
Chapter 3. Requirements for the construction and placement of business objects in the places of the largest concentration of the population (a complex of a stop trading place) of the territory of the city of Zhanaozen and adjacent villages
- For the construction and placement of objects of entrepreneurial activity in places of a large concentration of the population of the territory of the city of Zhanaozen and adjacent villages (a complex of a stopping trading place), trading places are provided for a period of 1 year with the right of temporary gratuitous land use.
- After the full registration of documents for the land plot, the object must be completed and put into operation within 6 months. It is allowed to extend the period after launch.
- Before the development of a land plot on a temporary gratuitous basis, the commission of civil transactions (sale, donation) is not allowed, a restriction is imposed.
- Construction works at the facilities must comply with the draft design approved by the State Institution "Zhanaozen City Department of Architecture and Urban Planning".
- Площадь выделенного земельного участка должна использоваться в следующих объемах: 60 (шестьдесят) процентов - коммерческий объект, 20 (двадцать) процентов - открытая остановка, 20 (двадцать) процентов -закрытая остановка.
- Expenses for the restoration or construction of a bus stop complex, maintenance of the facility and utility costs must be reimbursed at the expense of the entrepreneur in the event of demolition of landscaping facilities or damage to utility networks. In addition, next to the site where the stop will be located, along the highway undertakes to build a pocket (pocket).
- On an ongoing basis, work should be carried out to preserve the architectural appearance of the objects being introduced, increase their artistic and aesthetic attractiveness (renovation of building facades, facade decoration, painting, lighting design at night, cleaning of the adjacent territory), landscaping and landscaping.
- In case of non-fulfillment of the specified requirements, the agreement on the temporary gratuitous transfer of the land plot for lease will be terminated unilaterally after the issuance of the notification notice and returned to the ownership of the state.
Chapter 3. Organization of the Commission's activities
- The Chairman organizes the work of the Commission and ensures timely and high-quality performance of the tasks and functions assigned to the Commission by this Regulation.
- The working body of the Commission (hereinafter referred to as the working body) is the Zhanaozen City Department of Entrepreneurship and Agriculture.
- The formation of the agenda of the Commission meeting, the determination of the date and place of the commission meeting and the convocation of the commission members, the direction of the commission's decision to the land commission and other necessary measures are provided by the Working Body.
- The decision of the Commission is considered competent if at least two thirds of the total number of its members participate in it.
- The decision of the Commission is taken by open vote. The voting results are determined by a majority vote of the total number of members of the commission participating in the meeting, the decision is considered adopted if the majority of the commission members voted for it.
- One copy of the positive conclusion of the commission with the applicant's documents is sent to the land commission for the conclusion within five working days.
- The project participants are individuals and legal entities.
- In case of expressing a desire to obtain trading places for the construction and placement of business objects (a complex of a stop trading place) in the places of the largest concentration of the population of the territory of the city of Zhanaozen and adjacent villages, the following documents are submitted:
1) an application indicating a specific place to participate in the project;
2) for an individual – an identity document, for a legal entity – a certificate of state registration of a legal entity;
3) a copy of the certificate of confirmation of private entrepreneurship;
4) copies of any documents defining financial or material capabilities that are of any priority for the construction and implementation of a stopping place.
- The completeness and compliance of the documents of the applied business entities with the requirements of the law is checked, a decision on rejection or approval of the project is made at the meeting of the Commission.
