Announcement of a tender (electronic auction) for the sale of a land plot or the right to lease a land plot
The State Institution "Zhanaozen City Department of Land Relations" informs that on March 09, 2023 at 10:00 a.m. (Astana time) an electronic auction is being held for the sale of a land plot or the right to lease a land plot using the English method (for price increases) on the web portal of the State Property Register www.gosreestr.kz (hereinafter referred to as the Portal).
Applications for participation in the auction are submitted in accordance with the order of the Minister of Agriculture of the Republic of Kazakhstan dated October 15, 2021 No. 297 "On approval of the Rules for organizing and conducting auctions (tenders, auctions) for the sale of land plots or the right to lease land plots in electronic form on the web portal of the Register of State Property".
Registration of auction participants is made from the date of publication of the notice and ends five minutes before the start of the auction, that is, applications are accepted from February 17, 2023 to March 09, 2023 at 09:55 (Astana time).
To participate in the auction, the participant submits an application on the web portal and signs with an electronic digital signature (hereinafter referred to as EDS).
If the data specified in the application is changed, the participant makes changes to the data on the web portal within 1 (one) business day.
The bidder's application contains the bidder's consent to the terms of the auction and a price offer uploaded to an electronic envelope on a specially designated page of the web portal with the attachment of electronic (scanned) copies of documents confirming compliance with the terms to the bidders (buyer) specified in the application.
Foreigners or foreign legal entities submit electronic (scanned) copies of notarized copies of a foreign passport or constituent documents with a notarized translation into Kazakh and (or) Russian.
Documents of foreigners, stateless persons, foreign legal entities, legal entities of the Republic of Kazakhstan with foreign participation, as well as kandases are not accepted for registration as a bidder, if the provision of the object of bidding to such persons is prohibited in accordance with part three of paragraph 1 of Article 24 of the Land Code.
The grounds for refusal to accept the application are:
1) non-compliance by the participant with the conditions specified in paragraph 14 of these Rules, as well as non-receipt of the guarantee fee specified in the auction announcement to the organizer's account five minutes before the start of the auction;
2) in accordance with the third paragraph of paragraph 2 of Article 20 and part three of paragraph 1 of Article 24 of the Land Code;
3) if the participant is in accordance with article 96-1 of the Land Code in the register of persons from whom land plots have been forcibly withdrawn.
The web portal assigns an auction number to the participant whose application is registered and accepted.
Attention! Bidders for an increase in the price within 1 (one) hour before the start of the auction enter the auction hall using the digital signature and auction number, indicate their price offer for the object of bidding, which is not lower than the initial price.
If at the end of the auction for a price increase at 17:00 the winner of the auction is not determined, then the winner is the participant who last confirmed his desire to purchase the object of the auction, and the auction for this object of the auction is recognized as having taken place.
If, at the time of the auction, less than two auction participants have registered and are in the auction hall for the auction object, then the auction for this auction object is considered invalid (with the exception of the third auction (auction for lowering the price), at which the sale of the auction object to a single participant is allowed).
The guarantee fee of the bidder is a security for the conclusion of a contract for the purchase and sale of a land plot or the right to lease a land plot on the terms stated when participating in the auction, in accordance with the protocol on the results of the auction.
The guarantee fee is not refunded in accordance with paragraph 10 of Article 916 of the Civil Code of the Republic of Kazakhstan.
The results of the auction for each sold object of the auction are formalized by a protocol on the results of the auction, which is signed on the web portal by the seller and the winner using EDS on the day of the auction.
The protocol on the results of the auction is a document recording the results of the auction and the conditions for signing the contract of sale of a land plot or the right to lease a land plot between the winner and the seller.
The contract for the purchase and sale of a land plot or the right to lease a land plot is concluded in electronic format on the web portal and signed by the seller and buyer using EDS within 2 (two) working days from the date of signing the protocol on the results of the auction.
Settlements under the contract of sale of a land plot or the right to lease a land plot are made between the seller and the buyer. At the same time, the buyer transfers payments to the organizer in the following order:
1) a deposit (advance payment) is made in the amount of 50 (fifty) % of the sale price within 2 (two) working days from the date of signing the contract of sale of the land plot or the right to lease the land plot.
The guarantee fee is credited to the account of the advance payment due;
2) the remaining amount is paid no later than 30 (thirty) calendar days from the date of signing the contract of purchase and sale of the land plot or the right to lease the land plot.
If the winner refuses to sign a protocol on the results of the auction or a contract for the sale of a land plot or the right to lease a land plot within the prescribed time, the seller signs an act on the cancellation of the results of the auction, formed on the web portal, and this object of the auction is again put up for auction with the terms of the canceled auction.
The transfer of the bidding object is carried out according to the act of acceptance and transfer signed on the web portal by the seller and the buyer no later than 10 (ten) working days from the date of full payment by the buyer of the sale price under the contract of sale of the land plot or the right to lease the land plot.
In case of non-fulfillment by the buyer of the conditions for payment of the final payment within the time limits established by subparagraph 2) paragraph 58 of these Rules, the buyer within 10 (ten) calendar days pays a penalty (penalty) for the overdue period from the day when the amount for the land plot was to be paid until the day of payment.
