On December 20, 2019, the heads of the countries of the Eurasian Economic Union (EAEU) signed an Agreement on pension provision for workers of the member states of the Eurasian Economic Union, which will regulate the issues of pension provision for workers of the EAEU countries and their family members.
Despite the fact that this Agreement has been signed, it will enter into force only after its ratification by the parliaments of all the EAEU countries.
Nevertheless, citizens of the EAEU countries, including citizens of the Republic of Kazakhstan who work in the EAEU countries, need to know the following:
The EAEU countries include: Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia;
The agreement defines that a worker is a citizen of a member state of the EAEU, whose pension rights are being formed or have been formed through the exercise of labor or other activities on the territory of another member state;
the formation of workers' pension rights is carried out at the expense of pension contributions on the same terms and in the same manner as the formation of pension rights of citizens of the State of employment.
At the same time , pension contributions include:
in Armenia – taxes and (or) other contributions that give the right to a pension;
in Belarus – insurance premiums for compulsory pension insurance;
in Kazakhstan – pension contributions to the unified accumulative pension fund;
in Kyrgyzstan – insurance contributions to the Pension
Fund and the State Funded Pension Fund;
in Russia – insurance premiums for compulsory pension insurance.
In each of the EAEU countries, pension contributions are deducted for employees who are officially employed, that is, they work under an employment or civil contract, respectively, if a citizen works in the shadow sector, pension contributions will not be paid for him and this Agreement will not apply to him.
In this regard, workers, including citizens of the Republic of Kazakhstan, who carry out or in the future plan to carry out work activities in the EAEU countries, in order to form pension rights and their subsequent implementation under the Agreement (receiving a pension for work experience acquired in the EAEU countries after the entry into force of the Agreement), it is mandatory to conclude employment or civil law contracts with employers.
