On December 20, 2019, a meeting of the Supreme Eurasian Economic Council was held in St. Petersburg, at which the heads of the member States of the Eurasian Economic Union (EAEU) signed an Agreement on Pension Provision for Workers of the EAEU member States (hereinafter referred to as the Agreement), which will enter into force after passing the ratification procedure by all EAEU countries.
After the entry into force of the Agreement, a citizen from any EAEU country, including Kazakhstan, temporarily residing and working under an employment contract in the EAEU countries, will form his pension rights by paying pension contributions to the pension fund of the country of employment.
Considering that each member state of the EAEU will pay a citizen a part of the pension adequate to the period of work and pension contributions in the country of employment, it is necessary that workers formalize labor relations with employers in the EAEU member states, that is, conclude labor, civil contracts, thereby forming their pension rights.
In turn, the exercise of the right to the appointment and payment of pensions for the length of service earned after the entry into force of the Agreement will be carried out on the same conditions as for citizens of the country of employment.
The types of pensions assigned by the EAEU member States to which the Agreement will apply are determined by Article 2 of the Agreement.
In Kazakhstan, the Agreement will apply to legal relations on the payment of pension contributions to the UAPF and pension payments from the UAPF:
upon reaching retirement age (according to the legislation of Kazakhstan);
when establishing disability of groups 1 and 2, if the disability is established indefinitely (according to the legislation of Kazakhstan);
one-time payment to heirs.
The list of documents for the appointment and payment of a worker's pension will be regulated by the national legislation of each EAEU member state.
The worker will have the right to apply for the appointment and payment of a pension to the competent authority of the State of residence and (or) employment.
