Clarifications on the indicator "Enforcement of contracts" rating "Doing Business"

On November 5, the Department of Justice of the Turkestan Region, with the assistance of the Chamber of Entrepreneurs, held a meeting with business representatives, during which explanations were given about the work being done to improve the system for protecting the rights of entrepreneurs, as well as legislation in the field of enforcement proceedings and the activities of bailiffs.

Taking into account the dominant role of business in strengthening the country's economy, the Head of State pays special attention to creating appropriate conditions for the development of entrepreneurship.

Along with the adopted business support programs, in the Epostile of the President of the Republic of Kazakhstan to the people of Kazakhstan on October 5, 2018 "The growth of the welfare of Kazakhstan: an increase in income and quality of life" once again, the high importance of business development in Kazakhstan was noted and the corresponding tasks were assigned to government agencies.

At the same time, in order to determine and improve the situation on the conditions created in the country for comfortable business compared to other 190 countries, Kazakhstan has been participating in the Doing Business rating of the World Bank since 2009, based on 10 indicators.

One of the indicators - “Execution of contracts” - reflects the situation on the conditions created in the country to protect the rights of entrepreneurs.

In Kazakhstan, the Ministry of Justice, the Supreme Court and the Prosecutor General's Office are responsible for the positions on this indicator.

Due to the fact that enforcement proceedings are the final stage of the protection of violated rights, designed to enforce entered into force acts and other enforcement documents, the effectiveness of the procedures in the framework of enforcement proceedings also matters in the rating.

For example, in accordance with the legislative innovations adopted in May 2018, the procedural steps are regulated in terms of lifting the restriction on exit - 3 days and repealing measures to suspend special rights - 1 day.

A provision is also provided for in terms of granting the judicial executors the authority to apply to the court with the idea of changing the method and procedure for execution in all categories of cases(previously, only the state judicial executors had such a possibility on the documents on the execution of claims in favor of the state).

The right of the bailiff who sold the property to remove the arrests of other bailiffs has been introduced.

To reduce financial costs, a maximum amount of advance payment was set in the amount of 15 MCI.

It should be noted that according to the “Doing Business” rating, Kazakhstan ranked 6th in the “Contract Enforcement” indicator in 2018.
