The Ministry of Justice proposes to reform the procedure for attestation of persons applying for legal, notarial activities and private judicial enforcement in order to reduce corruption risks and a phased transition to self-regulation.
It should be noted that at the present time, persons who have successfully completed an internship at the bar association, notary chamber and private bailiffs are being certified by the relevant commissions established at the regional justice agencies of regions and cities of republican significance. One of the stages of certification is computer testing for knowledge of the legislation of the Republic of Kazakhstan, which is carried out in the territorial departments of justice.
However, the organization of this process requires a more developed technological infrastructure and specially trained personnel.Testing is proposed to be carried out on the basis of JSC "National Center for Civil Service Personnel Management" and regional testing centers. This institution has all the necessary resources for this, an effective experience in the development, implementation and technical support of software testing and confirmation of the level of competence of the test.
At the same time, the development of test tasks will be carried out by the Republican Bar Association, the Republican Notary Chamber and the Republic Chamber of Private Enforcement Officers.
In addition, the procedure for passing testing applicants will be conducted on a fee basis.
This initiative will not only mitigate the risks of corruption, but also ensure transparency and objectivity of certification.
