The mechanism of consideration of requests and views of human rights treaty bodies has been launched

On February 1, 2022, Kazakhstan set the procedure (rules) for consideration of the requests and views of human rights treaty bodies recognized by the Republic of Kazakhstan.

The mechanism of consideration of requests and views provided by the Rules was formed on the basis of established practice and aimed to ensure a systematic approach to their consideration.

The mechanism allows to involve the author of the complaint and the Permanent Representative of the United Nations in the Republic of Kazakhstan in the process of consideration of the requests and views, which will contribute to an objective and comprehensive resolution of the raised issues.

Requests and views are subject to consideration collectively by the Interdepartmental Working Group, which activities are coordinated by the Ministry of Justice of the RoK. Within the framework of the Working Group, the General Prosecutor`s Office of the RoK carries out a legal analysis of compliance on issues raised in the request or view with the rule of law, the Ministry of Foreign Affairs of the RoK sends the position of the Republic of Kazakhstan through diplomatic channels to the human rights treaty bodies.

This procedure will serve as the basis for the fundamental formation of a national legal mechanism for resolving issues about the status of the views of treaty bodies and the implementation of their decisions in domestic legal practice.
