The Ministry of Justice recommends holding an extraordinary congress of the PB

The Ministry of Justice of the Republic of Kazakhstan as an authorized organization expresses extreme concern over the state of affairs in the sphere of private judicial execution.

In february of this year,the Ministry of Justice approached the head of the PB Chamber with a proposal to hold discussions with the regional Chambers at all level.However,to date,no measures have been taken.

That is,the current leadership of the Chamber of PB showed its steady inability to perform its functions.

1.In particular,members of the Chamber aren't provided with free access to information on the incomes and expenses  of the Chamber.Accordingly,they can't make an informed decision on the effectiveness or inefficiency of the work of the PB leadership.

2.A large debt for services to support and develop the AIS of the IPR,which threatens the full functioning of this system,and the hence the work of all bailiffs,has been formed.

At the same time,the leadership of the Chamber doesn't have a clear strategy for solving this problem.

3.No measures have been taken to recover debts of "Auction One" LLP to the Chamber of PB in the amount of KZT 112 million.Under the agreement with the Chamber,"Auction one" LLP undertook to transfer half of its income in 2017.

4. The PB staff unjustifiably swings,during 2017 and 2018,a lot of expensive events were held,and business trips were also financed foreign,which didn't bring much benefit to the development of the institute PB.

5.The Chamber doesn't ensure a sufficient pace of development of the PB institute and doesn't carry out activities aimed at improving the transperency of information systems,reducing the time and improving the quality of services and private judicial executors

The Ministry of Justice will continue to work consistently to ensure the effective performance of bailiffs and,in accordance with the procedure established by law,take all necessary measures to bring to justice those responsible for destabilizing the institution of private judicial execution.   

Given to above,in order to discuss the accumulated problems,the Ministry of Justice considers it necessary to hold an extraordinary congress of the PB.
