Informative report

«On the Internet portal of open regulatory legal acts legalacts.egov.kz for public discussion Law of the Republic of Kazakhstan «On introducing amendments and additions to the Code of the Republic of Kazakhstan on Administrative Offenses».

The bill is aimed at further improving the administrative and tort legislation,as well as humanization and reduction of repressiveness of the Code of Administrative Offenses (further - the Administrative Code), including in part:

- transfer of a number of administrative offenses to civil or disciplinary responsibility;

- revision of administrative sanctions for possible mitigation and reduction;

- differentiation of powers between the court and outside the courts to review cases of administrative violations (with the exception of cases involving confiscation (Art.45 of the Administrative Code), deprivation of special rights (Art. 46 of the Administrative Code),forced demolition of illegally constructed or erected building(Art. 49 of the Administrative Code), administrative arrest (Art. 50 CAO);

- combining formulations offenses,establishing liability for advertising of individual products,work or service,in one article of the Code of Administrative Offenses.

- step-by-step transfer of proceedings on administrative offenses to electronic format;

-Elimination of legal gaps and collisions identified in the law enforcement practice of the Administrative Code.

Adoption of the bill won't  entail a reduction in revenues or an increase in the expenditures of the republican and local budgets.
