Informative report. Cancel printing for private businesses

In order to achieve the goal set by the Head of State to join the top 30 countries in the ranking «Doing Business» The Ministry of Justice is conducting systematic work to improve the business climate in the country and positions of Kazakhstan in the ranking «Doing Business» World Bank. 

In order to reduce business transaction costs, on May 28, 2018, the Law «On making amendments and additions to some legislative acts of the Republic of Kazakhstan on improving the regulation of business activities» amended article.

10 Entrepreneurial Code on imposing a ban on state agencies and financial institutions to seek the printing of documents from legal entities, related to private businesses.  

So, to certify documents, private business entities are not obliged to use stamps, the signature of an authorized person is enough.

At the same time, changes don't mean a ban on the use of stamps.Private entrepreneurs have the right to use the seal in their activities or to abandon it at their discretion.

The right not to use the seal will significantly simplify the interaction of subjects of private entrepreneurship with government agencies, financial organizations.        

Also, according to the new amendments, government agencies, financial organizations, including second-tier banks, are not entitled to require a seal stamp as a mandatory document requisite.They are obliged to accept documents of subjects of private entrepreneurship, certified only by the signature of an authorized person.

Amendments to legislative acts on the exclusion of mandatory printing for legal entities,related to private businesses, based on recommendations from World Bank experts and applying country experiences - USA, Denmark, Norway, Sweden, Germany, Austria, Switzerland, UK, Australia, Canada, Finland and Georgia to ensure ease of doing business.

In the USA, Denmark, Norway, Sweden, Germany, Austria, Switzerland, Great Britain, Australia, Canada, Finland, Georgia, Ukraine don't need a seal to register and conduct business,those the presence of the seal is not fixed by law.Manages the affairs of the company and is solely responsible for the decision or inaction is the director - an individual.
