The bodies of justice, internal affairs, economic investigations and state revenue are taking measures to protect intellectual property rights.
Since the beginning of 2024, the territorial justice authorities have issued 138 acts on the appointment of inspections. According to the results of the inspections, 132 offenses were revealed.
According to Article 158 of the Code of the Republic of Kazakhstan "On Administrative Offenses" (hereinafter - the Administrative Code), 133 cases were initiated, 111 persons were brought to administrative responsibility. There are 22 cases pending before the court. The total amount of fines amounted to 9,494,810 tenge.
257,174 units of counterfeit products were seized from illegal trafficking for a total amount of 46,956,439.72 tenge.

In the first half of 2024, under Article 198 of the Criminal Code of the Republic of Kazakhstan (hereinafter – CC of RK) (violation of copyright and related rights), 2 materials on violations of copyright and related rights were registered, which are being checked.
Special attention is paid to the identification of the above-mentioned violations on the Internet. Since the beginning of the year, 38 sites have been identified, information about which was sent to the Ministry of Culture and Information of the Republic of Kazakhstan through the Cybernadzor system to block access by domestic users.
As of July 1, 2024, the Customs Register of Intellectual Property Objects of state Revenue Bodies contains 1,025 trademarks of 332 copyright holders.
Based on the Customs Register of Intellectual Property Objects, for 6 months of 2024, the territorial bodies of state revenue suspended the release of goods according to 339 declarations for goods with signs of violation of intellectual property rights for a total value of 18.6 million US dollars.
During the showed period, the state revenue authorities, based on the statements of the right holders on suspended declarations for goods in respect of participants in foreign economic activity, compiled 11 administrative materials under Article 158 of the Administrative Code and the court confiscated 484 units of goods with subsequent destruction on 8 materials, as well as imposed a fine in the amount of 790,088.
According to the results of the first half of 2024, the territorial divisions of financial monitoring bodies registered 2 pre-trial investigations into violations of intellectual property rights (art. 198 of CC of RK and art. 222 of CC of RK).
These facts were established on the territory of Shymkent city, the total damage for which amounted to 35 million tenge (the trademark baby diapers «Mama knows» and the software «Accounting for state-owned enterprises of Kazakhstan»).
