Methodical recommendations on legal monitoring of normative legal acts and on preparation Of concepts and projects of NPA

These guidelines are designed to achieve social and political elaboration of laws, as well as to improve the quality and unification of legal technology.
Thus, the legal monitoring of normative legal acts should be understood as a mechanism for continuous monitoring, analysis, evaluation of the development of law and corrective impact on the legal sphere. That is, the legal monitoring of NPA is a constant process aimed at improving the norms of national legislation.
Thus, the process of legal monitoring continues as follows.
Analysis of normative legal acts and practice of its application. This work is to identify contradictions, conflicts, gaps in the norms of the current legislation, the result of which is to develop proposals to improve the legislative act (individual provisions, norms of the NPA), as well as by-laws and regulations aimed at implementing the provisions of the analyzed NPA.
Implementation of the results of the analysis of normative legal acts and practice of its application. Based on the results of the analysis of normative legal acts and the practice of its application, the Concept and draft of the NPA is developed. It should be noted that the preparation of the Concept and the draft NPA the main issue is to anticipate the consequences of adoption of legislative acts, which allow to evaluate the possible negative socio-economic consequences of the adoption of the legislative act at a very early stage concept development.
The adopted NPA as the current legislation is also subject to analysis of the practice of its application.
Thus, legal monitoring is of a continuous, cyclical nature, since the analysis of legislative acts allows to identify gaps, contradictions and conflicts and to make proposals for the correction of legislation through the development of draft concepts.
The analysis of legal monitoring in the Republic of Kazakhstan showed that the common feature uniting this activity is the constant determination of the degree of effectiveness of national legislation, acting as an effective mechanism for improving legislation.
