Criminal liability for failure to comply with a court decision on alimony

Over the past period of 2024, the Specialized Interdistrict Juvenile Court issued two convictions against persons, debtors in enforcement proceedings for the collection of alimony, of committing a criminal offense under Article 139 of the Criminal Code of the Republic of Kazakhstan. Two debtors were found guilty by the court under Article 139 of the Criminal Code of the Republic of Kazakhstan, as failure to fulfill obligations by a parent for more than three months to pay funds under a court decision for the maintenance of minor children, and they were sentenced to one year of restriction of freedom. In the case of malicious evasion from serving a sentence by a person sentenced to restriction of freedom, the unserved term of restriction of freedom is replaced by a punishment in the form of imprisonment at the rate of one day of imprisonment for one day of restriction of freedom.
