In accordance with article 14-2 of the Law "On State Registration of Legal Entities and Registration of Branches and Representative Offices", information about the change of the head of a legal entity is entered automatically through the e-government web portal on the basis of an electronic notification. This requirement applies to all legal entities.
At the same time, the Ministry of Justice receives complaints related to the lack of a service for changing the head of a legal entity on the e-government portal.
As practice has shown, if there is a dispute between the parties for a short period, information about the change of the head is entered through the portal by the participants, often in the absence of legal grounds.
In this regard, in order to resolve the problems that have arisen and finalize the portal for submitting notifications, from November 1, 2022, the provision of services for changing the head of all legal entities (commercial and non-commercial) has been suspended on the e-government portal (hereinafter referred to as the PEP).
In connection with the above-mentioned format change, the territorial bodies of justice and the NAO "State Corporation "Government for Citizens" (hereinafter referred to as the State Corporation) need to organize work on accepting notifications in paper form through the office, and also take appropriate measures for legal explanatory work among the population.
Currently, the PEP is being finalized for submitting electronic notifications only through an electronic digital signature of a legal entity, since in accordance with Article 14-2 of the Law, the legal entity is responsible for the completeness and reliability of the information entered;
Based on the above, in case of receipt of notifications about the change of the head of legal entities of all organizational and legal forms, Departments and branches of the State Corporation need to receive notifications on paper with the entry of information about the change of the head.
