Certification of persons applying to engage in the activities of a private bailiff

The date of the event is March 2, 2022 at 10-00 o'clock.
Certification is carried out in accordance with the Rules for the provision of public services "Certification of persons applying to engage in the activities of a private bailiff", approved by Order of the Minister of Justice of the Republic of Kazakhstan No. 69 dated 29.05.2020 (hereinafter - the Rules).
The main requirements for persons applying to engage in the activities of a private bailiff are: a citizen of the Republic of Kazakhstan with a higher legal education, who has completed a continuous internship with a private bailiff.
The applicant's knowledge of the Civil Code of the Republic of Kazakhstan, the Civil Procedure Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan, the Code of Administrative Offenses of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Enforcement Proceedings and the status of bailiffs".
Admission to certification is refused on the grounds provided for in paragraph 2 of Article 140 of the Law of the Republic of Kazakhstan "On Enforcement Proceedings and the Status of Bailiffs", namely, if a person is recognized as legally incompetent or partially capable in accordance with the procedure established by the law of the Republic of Kazakhstan; having a criminal record that has not been extinguished or not removed in accordance with the procedure established by law; released from criminal liability on the basis of paragraphs 3), 4), 9), 10) and 12) part one of Article 35 or Article 36 of the Criminal Procedure Code of the Republic of Kazakhstan, within three years after the occurrence of such events; dismissed for negative reasons from state, military service, from the prosecutor's office, other law enforcement agencies, special state bodies of the Republic of Kazakhstan, within one year from the date of dismissal; dismissed from the position of a judge on the grounds provided for in subparagraphs 11) and 11-1) of paragraph 1 of Article 34 of the Constitutional Law of the Republic of Kazakhstan "On the judicial system and the status of Judges of the Republic of Kazakhstan", within one year from the date of release; for which, within three years prior to the empowerment of a private bailiff, an administrative penalty was imposed in court for committing a corruption offense; registered in organizations providing medical care in the field of mental health, for mental, behavioral disorders (diseases), including those related to the use of psychoactive substances; deprived of a license of a private bailiff on the grounds provided for in paragraph 2 of Article 144 of this Law, within three years from the date of entry into force of the court decision.
The documents are accepted no later than five working days before the day of certification sends the application to the service provider through the e-government web portal www.egov.kz . from the date of publication of the announcement on the Internet resource of the Department of Justice of the North Kazakhstan Region.
The acceptance of documents and the issuance of the results of the provision of public services is carried out through the E-Government web portal: www.egov.kz .

When submitting all the necessary documents, the status of acceptance of the request for the provision of public services is displayed in the "personal account" of the service recipient.
The service recipient consents to the use of information constituting a legally protected secret contained in information systems in the provision of public services, unless otherwise provided by the laws of the Republic of Kazakhstan.
