Regulations on a state institution

"Department of Culture, Language Development, PhysicalCulture and Sports of Kurchatov cityобласти, Abay region"

 

  1. General provisions

 

  1. The State institution " Department of Culture, Language Development, Physical Culture and Sports of Kurchatov city, Abay region"(hereinafter referred to as the Department) is a state body of the Republic of Kazakhstanthat manages culture, language development, physical culture and sports in the territory of Kurchatov city.
  2. The Department carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
  3. The Department is a legal entity in the organizational and legal formof a state institution, has a seal with the image of the State Emblem of the Republic of Kazakhstan and stamps with its name in the state language, forms of the established sample, accounts with treasury bodies in accordance with the legislation of the Republic of Kazakhstan.
  4. The Department enters into civil relations on its own behalf.
  5. The Department has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation of the Republic of Kazakhstan.
  6. The Department on issues of its competence, in accordance with the procedure established by law, makes decisions issued by orders of the head of the Department and other acts provided for by the legislation of the Republic of Kazakhstan.
  7. The structure and staffing limit of the Department are approved in accordance with the current legislation of the Republic of Kazakhstan.
  8. Location of the legal entity:4 Tauelsizdik Street, Kurchatov city, Abay region, Republic of Kazakhstan,, город Курчатов, улица Тәуелсіздік071100.
  9. This regulation is the constituent document of the Department.
  10. The Department's activities are financed from the local budget of the city of Kurchatov in accordance with the legislation of the Republic of Kazakhstan.
  11. The Department is prohibited from entering into contractual relations with business entities regarding the performance of duties that are the authority of the Department.

If the Department is granted the right to carry out income -generating activities by legislative acts, the received income is sent to thestate budget, unless otherwise established by the legislation of the Republic of Kazakhstan.

 

  1. Tasks and powers of the Department

 

  1. Department Tasks:

1) implementation of the state policy in the sphere of culture, language development, physical culture and sports;

2) ensuring the enhancement of the role of cultural and educational institutions in ideological, moral, aesthetic, sports education and language development;

3) further improvement of forms of cultural services for the population;

4) development of all types of art, folk art, folklore and amateur performance;

5) promotion of the activities of creative unions and organizations;

6) implementation of measures to strengthen and update the material and technical organizations of cultural and sports institutions;

7) development of the state language and languages of the people of Kazakhstan;

8) development of physical culture and sports, promotion of a healthy lifestyle among the city's population;

9) creating conditions for the development and popularization of mass sports and involving the population in physical culture and sports.

10) protection and use of objects of historical and cultural heritage.

  1. Authority:

1) rights:

1.1. submit proposals to the city administration for consideration on issues falling within the competence of the Department;

1.2. within the competence provided for by the legislation of the Republic of Kazakhstan, involve employees of other departments of local executive bodies of the city for consideration and joint development of issues related to the Department's activities;

1.3. initiate meetings in accordance with the established procedure on issues falling within the competence of the Department;

1.4. request, within the competence established by the legislation of the Republic of Kazakhstan, from other state bodies, officials, organizations and their managers, citizens, information necessary for the performance of their functions;

1.5. give advice on issues within the competence of the Department;

1.6. submit the necessary materials and information within the scope of their competence and within the framework of the legislation in the event of an official request to do so by legal entities and individuals;

1.7. provide public services in accordance with the standards and regulations of public services;

1.8. exercise other rights within the competence of the Department

2) responsibilities:

2.1. provide high-quality public services to the population in accordance with the current legislation;

2.2. perform acts and instructions of the President, the Government of the Republic of Kazakhstan and other central executive bodies, akim and akimat of the region, akim of the city in a high-quality and timelymanner;

2.3. perform other duties within the competence of the Department

  1. Functions:

1) ensure that appeals of individuals and legal entities, official correspondence are considered in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

 2) ensure the availability and quality of public services provided in accordance with the legislation of the Republic of Kazakhstan;

3) implements the state policy in the sphere of culture, language development, physicalуculture and sports;

4) create, reorganize, liquidate state cultural organizations of the city in the field of library and cultural and leisure activities in accordance with the procedure established by the legislation of the Republic of Kazakhstan in coordination with the authorized body;

5) supports and coordinates the activities of state cultural organizations of the city of regional significance in the field of librarianship and cultural and leisure activities;

6)      organize the registration, protection and use of historical, material and spiritual monuments of local significance;

7)      holds spectacular cultural events of the city, as well as viewings, festivals and competitions among amateur creative associations;

8)   conducts certification of state cultural organizations of the city;

9)   within the limits of its competence, manages communal property in the field of culture and sports;

10)    acts as a customer for the construction, reconstruction and repair of cultural and sports facilities in the city;

11)    supports and assists in the material and technical support of state organizations of culture and sports;

12) conduct city-level events aimed at developing the state and other languages;

13) make proposals to the executive bodies of the region on naming and renaming streets, as well as changing their transcription;

14) creates infrastructure for sports activities of individuals at their place of residence and in places of their mass recreation;

15) holds sports competitions in the city in cooperation with local accredited sports federations;

16) provides training of national teams of the city in sports and their performances at regional sports competitions;

17) ensure the development of mass sports and national sports on the territory of the relevant administrative-territorial unit;

18) coordinates the activities of physical culture and sports organizations on the territory of the corresponding administrative-territorial unit;

19) assigns sports categories to athletes: athlete of the 2nd category, athlete of the 3rd category, athlete of the 1st junior category, athlete of the 2nd junior category, athlete of the 3rd junior category;

20) assigns qualification categories: coach of the highest level of qualification of the second category, coach of the average level of qualification of the second category, methodologist of the highest level of qualification of the second category, methodologist of the average level of qualification of the second category, instructor-athlete of the highest level of qualification of the second category, sports judge;

21) implements a unified regional calendar of sports and mass events;

22) coordinates the organization and conduct of sports events on the territory of the relevant administrative-territorial unit;

23) collects, analyzes and provides the local executive body of the region with information on the development of physical culture and sports on the territory of the relevant administrative-territorial unit in the form and within the time limits established by the legislation of the Republic of Kazakhstan;

24) form and approve lists of national teams by sports on the proposals of regional and local accredited sports federations of the city;

25) organize medical support for official physical culture and sports events;

26) ensure public order and public safety during physical culture and sports events;

27) coordinates the construction of sports facilities on the territory of the city and ensures their accessibility to the population;

22.8) provides methodological and advisory assistance to sports organizations;

         29) exercise, in the interests of local state administration, other powers conferred on local authorities.

  1. Status and authority of the Department Head

 

 

  1. The management of the Department is carried out by the head, who is personally responsible for the performance of the tasks assigned to the Department and the performance of its functions.
  2. TheHead of the Department is appointed and dismissed by the Akim of the city of Kurchatov in accordance with the legislation of the Republic of Kazakhstan.
  3. The Head of the Department не has no deputies
  4. Powers of the Department Head:

1) appoint and dismiss employees of the Department in accordance with the procedure established by law;

2) carry out incentives and impose disciplinary penalties on employees of the Department in accordance with the procedure established by law;

3) issues orders, gives instructions, signs official documentation within the limits of its competence;

4) approve job descriptions of Department employees;

5) represents the interests of the Department in state bodies and other organizations;

6) approves the staffing table of the Department within the limits of the number of staff and structure approved by the decree of the Akimat of Kurchatov city;

7) take the necessary measures to combat corruption and bear personal responsibility for this;

8) ensure equal access of men and women to public service in accordance with their experience, abilities and professional training;

9) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.

Execution of the powers of the head of the Department during his absence is carried out by the person replacing him in accordance with the current legislation of the Republic of Kazakhstan.

 

  1. Property of a state body

 

  1. The Department may have separate property on the right of operational management in cases stipulated by the legislation.

The property of the Department is formed at the expense of the property transferred to it by the owner, as well as property acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

  1. The property assigned to the Department belongs to communal ownership.
  2. The Department has no right to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by the legislation and this Regulation.

 

  1. Reorganization and abolition of a state body

 

  1. The Department is reorganized and abolished in accordance with the legislation of the Republic of Kazakhstan.

  4. Municipal state Institution "Language Training Center of Kurchatov city, Abay region";
  5. Municipal state institution "Sports Club" of Kurchatov city, Abay region.
