Information for the press

Following the instruction of the Head of State, the General Prosecutor's Office has been working on the establishment of all causes and details of the "Almaty tragedy" and terrorist attacks in other regions.

Law enforcement agencies are taking all necessary measures to identify and punish the perpetrators of terrorist acts, to fully restore public safety in the country.

Particular attention is being paid to investigating the incidents where human casualties have occurred.  

The total number of casualties across the country is being established.

Each fact will be thoroughly investigated by making an appropriate legal assessment.

For offenses committed during the state of emergency, 6,966 protocols for administrative proceedings have been prepared; 4,918 people have been subjected to various forms of administrative responsibility, including 1,978 people who have been arrested. Fines were imposed on 791 persons and 2,149 persons were issued warnings. 2,048 cases are pending in courts.

Investigatory teams are currently reviewing 494 criminal cases, including 44 cases of terrorism, 34 cases of mass riots, 15 cases of homicide, etc.

524 persons suspected of committing crimes were placed in temporary detention facilities. 412 persons were placed in pretrial detention with court authorization.

Necessary investigative measures are currently being carried out.

A person suspected of committing a crime may be detained without a court order for a period not exceeding 48 hours (part 2 of Article 14 of the Criminal Procedure Code).

But in the case of suspicion of a particularly grave, terrorist or extremist crime, a crime during a mass riot, or in a state of emergency, detention for a period not exceeding 72 hours is allowed (Article 131, part 4 of the CPC).

Detention for up to three hours is admitted in order to prevent an administrative offense, establish the identity of the suspect, and to file a report,.

If the sanction of the article, under which the administrative case was initiated, provides for arrest as one of the penalties, detention for up to 24 hours is admitted (part 3 of Article 789 of the Code on Administrative Offences).

Those who have violated the order established in connection with the curfew may be detained until the end of the curfew, and those who do not have their documents with them – until their identity is established, for no longer than 48 hours (Article 789 part 2 of the CAO).

Once their identity has been established, if there are no indications of criminal or administrative offenses in their actions, they shall be immediately released without taking any measure.

It should be noted that all persons who are brought in or detained are guaranteed their constitutional right to defend and to have qualified legal assistance.

Citizens and their representatives are entitled to file a relevant application with the local police and procurator's offices. Each application is subject to thorough check.
