
New requirements have been introduced into the procedure for submitting appeals to state bodies, which were previously absent in the Law that became invalid, namely, according to the new Administrative Procedural Code of the Republic of Kazakhstan No. 350-VI of June 29, 2020 (hereinafter referred to as the Code), an appeal submitted orally is entered into a separate protocol by an official or an employee of the administrative body who accepted the appeal.
In an appeal submitted in writing or in the form of an electronic document, the protocol shall specify:
1) surname, first name, patronymic (if it is indicated in the identity document), individual identification number (if any), postal address of an individual or name, postal address, business identification number of a legal entity (if any);
2) the name of the administrative body, official to whom the appeal is submitted;
3) the essence of the appeal;
4) the date of submission of the application;
5) signature of the applicant or his representative;
6) other information provided by the legislation of the Republic of Kazakhstan.
An appeal submitted in accordance with the procedure established by this Code is subject to mandatory acceptance, registration, accounting and consideration. Refusal to accept an application is prohibited.
If an application is submitted to a state body, a local self-government body, a legal entity with one hundred percent participation of the state, the applicant is issued a coupon containing a unique number, indicating the date and time, surname and initials, position of the person who accepted the application.
The appeal is registered on the day of its receipt. If the request was received on a non-working day, it is registered on the next working day following it.
In case of non-compliance of the application with the requirements of this Code, the administrative body, the official shall indicate to the applicant what requirements the application does not meet, establish a reasonable period for bringing it into compliance with the requirements.
The administrative body or official shall return the application if the applicant has not brought it into compliance with the requirements of the legislation of the Republic of Kazakhstan within the time period established by the administrative body or official.
The return of a request does not prevent a second request. The applicant may withdraw the appeal on the basis of his written application before making a decision on an administrative case. The withdrawal of the application by the applicant does not deprive him of the right to submit a second application, provided that the deadlines are met, unless otherwise provided by the laws of the Republic of Kazakhstan.
An appeal received by an administrative body or an official whose authority does not include consideration of this appeal is forwarded to the authorized administrative body or official within three working days from the date of its receipt, with simultaneous notification (notification) of the participant in the administrative procedure.
One or more petitions, requirements contained in an appeal received by an administrative body, an official whose authority does not include their consideration, are forwarded to the authorized administrative body, an official within no later than three working days from the date of receipt, with simultaneous notification (notification) of the participant in the administrative procedure.
An administrative procedure shall be initiated by an authorized administrative body or an official in accordance with the procedure established by this Code for a redirected appeal or part of it.
The term of consideration of the complaint is twenty working days from the date of receipt of the complaint and can be extended up to 2 months.
The deadline for consideration of Applications, Requests, Responses, Proposals, Messages is 15 working days.
In this regard, we recommend that when submitting applications, strictly comply with the specified Code and other regulations in this area.
