Constitutional Court to Review the Constitutionality of State Fee Exemption Regulation in Court Appeals

Constitutional Court will review the constitutionality of a regulation concerning the exemption from state fees when filing court appeals.

Individuals with disabilities have petitioned the Constitutional Court to assess the constitutionality of Article 616, subparagraph 13) of the Tax Code, which currently does not exempt them from paying state fees when contesting judicial decisions where they were defendants.

According to the applicants, this provision infringes upon their right to judicial protection and creates disparities among individuals with disabilities when seeking legal recourse and challenging court rulings. They urge the Constitutional Court to scrutinize this Tax Code provision against the standards outlined in Articles 13 and 14 of the Constitution.

During the session at the Constitutional Court, representatives from the Prosecutor General's Office, as well as the Ministries of Justice, National Economy, Finance, Labor, and Social Protection, were present to discuss the matter.
