The Office of the Akim of Auliekol District

 

Районный (города областного значения) акимат - это коллегиальный орган, который не является юридическим лицом.

1. Районный (города областного значения) акимат в соответствии с законодательством Республики Казахстан:

      1-1) обеспечивает исполнение бюджета района (города областного значения);

      1-2) представляет в соответствующий маслихат и ревизионную комиссию области годовой отчет об исполнении бюджета района (города областного значения);

      1-3) принимает постановление о реализации решения маслихата района (города областного значения) о бюджете района (города областного значения) на соответствующий финансовый год;

      1-6) образует бюджетную комиссию района (города областного значения), утверждает положение о ней и определяет ее состав.

      В случае рассмотрения вопросов, затрагивающих интересы субъектов частного предпринимательства, к работе бюджетных комиссий привлекаются представители Национальной палаты предпринимателей Республики Казахстан в соответствии с законодательством Республики Казахстан;

      1-7) утверждает областной финансовый план района (города областного значения) на первый квартал соответствующего финансового года в случаях, предусмотренных бюджетным законодательством Республики Казахстан;

      1-8) разрабатывает и представляет на утверждение маслихата программу развития района (города областного значения), обеспечивает ее исполнение;

      1-9) обеспечивает включение мероприятий по энергосбережению и повышению энергоэффективности в программу развития соответствующего района, города областного значения, а также осуществляет информационную деятельность в области энергосбережения и повышения энергоэффективности;

      1-10) обеспечивает проведение государственной политики в области энергосбережения и повышения энергоэффективности;

      2) управляет районной (города областного значения) коммунальной собственностью в соответствии с законодательными актами, осуществляет меры по ее защите;

      2-1) определяет перечень районной (города областного значения) коммунальной собственности, передаваемой в состав коммунального имущества города районного значения, села, поселка, сельского округа;

      2-2) осуществляет регистрацию актов гражданского состояния и вносит сведения о регистрации в Государственную базу данных о физических лицах в порядке, установленном законодательством Республики Казахстан;

      3) содействует исполнению гражданами и организациями норм Конституции Республики Казахстан, законов, актов Президента и Правительства Республики Казахстан, нормативных правовых актов центральных и местных государственных органов;

      4) создает условия для развития предпринимательской деятельности и инвестиционного климата на территории района (города областного значения);

      4-1) осуществляет организацию выставочно-ярмарочной деятельности;

      4-2) определяет и утверждает места и (или) маршруты размещения нестационарных торговых объектов;

      5) обеспечивает рациональное и эффективное функционирование аграрного сектора;

      6) разрабатывает генеральные планы застройки поселков и сел, находящихся на территории данного района (города областного значения), и представляет их на утверждение в районный (города областного значения) маслихат, выступает заказчиком по строительству, реконструкции и ремонту объектов районной (города областного значения) коммунальной собственности и объектов социально-культурного назначения, дает разрешение на строительство внутрипоселковых (внутригородских) и внутрирайонных коммунальных сетей и сооружений;

      7) организует строительство и эксплуатацию водопроводов, очистных сооружений, тепловых и электрических сетей и других объектов транспортной и инженерной инфраструктуры района (города областного значения);

      8) обеспечивает организацию мероприятий по воинской приписке и призыву на воинскую службу, а также по вопросам гражданской обороны;

      9) организует перевозки пассажиров в соответствии с законодательством Республики Казахстан в сфере транспорта;

      10) осуществляет регулирование земельных отношений в соответствии с земельным законодательством Республики Казахстан;

      11) организует строительство, эксплуатацию и содержание дорог районного (города областного значения) значения;

      12) организует строительство жилья коммунального жилищного фонда и его распределение;

      12-1) организует сохранение коммунального жилищного фонда;

      12-2) проводит инвентаризацию жилищного фонда;

      12-3) осуществляет изъятие, в том числе путем выкупа, земельных участков для государственных надобностей;

      12-4) проводит мероприятия, направленные на поддержание сейсмоустойчивости жилых зданий, расположенных в сейсмоопасных регионах республики;

      12-5) организует снос аварийного жилья;

      12-7) обеспечивает жильем отдельные категории граждан в соответствии с законодательными актами Республики Казахстан;

      12-8) осуществляет передачу в собственность граждан жилищ из коммунального жилищного фонда на условиях, предусмотренных законодательными актами Республики Казахстан, и в порядке, определяемом Правительством Республики Казахстан;

      14) решает вопросы социальной защиты населения, охраны материнства и детства, оказывает адресную помощь социально уязвимым слоям населения, координирует оказание им благотворительной помощи и содействует кадровому обеспечению сельских организаций здравоохранения;

      14-1) обеспечивает организацию и осуществление деятельности в уголовно-исполнительной сфере в соответствии с Уголовно-исполнительным кодексом Республики Казахстан;

      14-3) исполняет иные полномочия в сфере оказания социальной и иной помощи лицам, освобожденным из учреждений уголовно-исполнительной системы, а также состоящим на учете службы пробации, в соответствии с законодательством Республики Казахстан;

      14-4) предоставляет жилищные сертификаты за счет бюджетных средств;

      15) вносит предложения об объявлении охраняемыми памятниками природы, истории и культуры находящиеся на территории района (города областного значения) природные и иные объекты, представляющие экологическую, историческую, культурную или научную ценность;

      16) решает вопросы благоустройства и внешнего оформления общественных мест;

      17) образует консультативно-совещательные органы по вопросам межведомственного характера с привлечением представителей Национальной палаты предпринимателей Республики Казахстан по вопросам, затрагивающим интересы субъектов частного предпринимательства, согласно законодательству Республики Казахстан;

      17-1) в пределах своей компетенции оказывает электронные услуги с применением информационных систем в соответствии с законодательством Республики Казахстан об информатизации;

      17-2) проводит организационную работу по созданию территориальных советов местного самоуправления и разрабатывает положения о территориальных советах местного самоуправления;

      18) организует проведение ветеринарных мероприятий на соответствующей территории, строительство и содержание специальных хранилищ (могильников), используемых в животноводстве, а также осуществляет организацию санитарного убоя больных животных;

      19) осуществляет реализацию гражданами права на бесплатное начальное, основное среднее и общее среднее образование;

      19-1) обеспечивает обучение участников избирательного процесса;

      20) создает в порядке, установленном законодательством Республики Казахстан, государственные учреждения и государственные предприятия, устанавливает лимит штатной численности исполнительных органов, финансируемых из районного (города областного значения) бюджета в пределах лимита штатной численности, доведенного областным исполнительным органом и нормативов, установленных Правительством Республики Казахстан;

      21) согласовывает решения органа государственных доходов по месту регистрационного учета налогоплательщика об изменении сроков исполнения налогового обязательства по уплате налогов, поступающих в полном объеме в районный (города областного значения) бюджет;

      22) осуществляет лицензирование в случаях и порядке, установленных законодательством Республики Казахстан о разрешениях и уведомлениях;

      23) организует деятельность по профилактике терроризма, а также минимизации и (или) ликвидации последствий терроризма на территории района, города областного значения через антитеррористические комиссии;

      23-1) участвует в профилактике чрезвычайных ситуаций социального характера, а также минимизации и (или) ликвидации их последствий на территории района, города областного значения;

      24) разрабатывает правила оказания социальной помощи, установления размеров и определения перечня отдельных категорий нуждающихся граждан на основе типовых правил, утверждаемых Правительством Республики Казахстан.

      25) организует работу по развитию физической культуры и спорта;

      26) создает организации по оказанию помощи в соответствии с Законом Республики Казахстан "О профилактике бытового насилия";

      27) осуществляет мониторинг социальной напряженности и рисков возникновения трудовых конфликтов;

      27) создает инфраструктуру для занятий спортом физических лиц по месту жительства и в местах их массового отдыха;

      28) обеспечивает жилищем чемпионов и призеров Олимпийских, Паралимпийских и Сурдлимпийских игр в соответствии с Законом Республики Казахстан "О физической культуре и спорте";

      29) организует осуществление раздельного сбора коммунальных отходов.

      1-1. Акимат района (города областного значения) проводит обсуждение проекта бюджета района (города областного значения) на заседании общественного совета, создаваемого в соответствии с Законом Республики Казахстан "Об общественных советах".

      Акимат района (города областного значения) проводит обсуждение годового отчета об исполнении бюджета района (города областного значения) на заседании общественного совета, создаваемого в соответствии с Законом Республики Казахстан "Об общественных советах".

      2. Акимат района, города областного значения осуществляет в интересах местного государственного управления иные полномочия, возлагаемые на него законодательством Республики Казахстан.

      3. Районный (города областного значения) акимат несет ответственность за реализацию возложенных на него функций перед районным (города областного значения) маслихатом.

      4. Полномочия, возложенные настоящей статьей на районные (городов областного значения) акиматы, в городе республиканского значения (столице) осуществляются городскими акиматами.

2. The state institution “Apparatus of Akim of  Auliekol District” shall provide informational, analytical, organizational, legal, financial and technical support for the activities of the Akim and Akimat of the district.

3. The state institution “Apparatus of Akim of  Auliekol District” shall carry out its activities in accordance with the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, as well as these regulations.

4. The state institution “Apparatus of Akim of  Auliekol District” is a legal entity in the legal form of a state institution. It has seals and stamps with its name in the state language, forms of the established sample and treasury accounts in accordance with the legislation of the Republic of Kazakhstan.

5. The state institution “Apparatus of Akim of  Auliekol District”  shall enter into civil law on its own behalf.

6. The state institution “Apparatus of Akim of  Auliekol District” shall have the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in compliance with the legislation.

7. In compliance with the procedure established by the legislation, the state institution “Apparatus of Akim of  Auliekol District”, on issues within its competence,  shall take decisions followed by the decree of the head of the state institution “Apparatus of Akim of  Auliekol District” (Akim of Auliekol District)

8. The structure and staff number limit of the state institution “Apparatus of Akim of  Auliekol District” shall be established in compliance with the current legislation.

11. These Regulations are a constitutive document of the state institution “Apparatus of Akim of  Auliekol District” .

12. Financing of the activities of the state institution  “Apparatus of Akim of  Auliekol District”shall be carried out from the local budget.

13. The state institution “Apparatus of Akim of  Auliekol District” shall be prohibited from entering into contractual relations with business entities for the fulfillment of duties that are the functions of the state institution “Apparatus of Akim of  Auliekol District”.

2. Mission, subject, purpose, main objectives, functions, rights and obligations of a state body

14. The mission of the state institution “Apparatus of Akim of  Auliekol District”is to ensure high-quality and timely informative, analytical, organizational, legal, financial and technical functioning of the Akim and Akimat of the region.

15. The subject of activity of the state institution “Apparatus of Akim of  Auliekol District”is to ensure the activities of the Akim and Akimat of the district.

16. The purpose of the activities of the state institution “Apparatus of Akim of  Auliekol District”  is to increase the efficiency of all structural units in the informative, analytical, organizational, legal, financial and technical support of the Akim and Akimat of the district.

17. Objectives of the state institution “Apparatus of Akim of  Auliekol District”:

1)ensuring the exercise of powers of the akim and akimat of the district within the competence established by the legislation of the Republic of Kazakhstan;

2) assistance in ensuring the implementation of a national executive policy in combination with the interests and needs of the development of the relevant territory;

3) other tasks established by the legislation of the Republic of Kazakhstan.

18. Functions of the state institution“Apparatus of Akim of  Auliekol District”:

1) study and analysis of the domestic political and economic affairs of the region, forecasting its development, analysis of the work of local executive bodies of the district and aul (rural) district, village and aul (village), financed from the local budget, preparation of information for the akim and members of the district akimat on issues requested by them;

2) providing coverage of the activities of the akim and akimat of the district in the media;

3) ensuring the publication of regulatory legal acts of the akim and akimat of the district in the media;

4) analysis of the performance discipline in the structural units of the akim of the district, as well as akims of the aul (rural) district, village and aul (village), which is not part of the aul (rural) district, and informing the akim;

5) on behalf of the akim and members of the akimat of the district, representation and protection of the interests of the akim and the akimat of the district in the courts, consideration of acts of prosecutorial response and other supervisory bodies;

6) planning and organizing the preparation and holding of meetings of the district akimat, meetings with the district akim and his deputies, seminars and other events,  typing and mailing of materials and meeting minutes;

8) control over the execution of acts and instructions of the President, the Government and central state bodies of the Republic of Kazakhstan, as well as the akim and akimat of the region by local executive bodies of the district, akims of the aul (rural) district, village and aul (village), which is not part of the aul ( rural) district;

9) the organization of timely consideration of incoming documents by the akim and members of the akimat, the implementation of their initial processing, preliminary consideration, registration, recording, storage, delivery and mailing;

10) organization and maintenance of records management of the akim and akimat of the district, including the secret ones in compliance with the requirements of regulatory legal acts;

11) assessment of the performance of local government bodies in compliance with the current legislation;

12) monitoring of public services provided by local executive bodies;

13) on behalf of the akim, members of the akimat of the district, conducting inspections, within the competence, if necessary, oral hearing, and requesting written explanations from the relevant officials;

14) coordination of the training and retraining of civil servants of the state institution “Apparatus of Akim of  Auliekol District”and the heads of executive bodies financed from the district budget;

15) organization and conduct of certification of civil servants of the state institution “Apparatus of Akim of  Auliekol District”and the heads of executive bodies financed from the district budget;

16) carrying out work to increase the level of informatization and the development of electronic akimat systems;

17) taking measures to develop electronic services provided by local executive bodies in compliance with the legislation of the Republic of Kazakhstan;

18) preparation of documents for submission to state awards, awards of akim of the region;

19) ensuring recording and consideration of appeals of individuals and legal entities, organization of personal reception of individuals and representatives of legal entities by the akim and members of the district akimat;

20) implementation of internal control in compliance with the legislation of the Republic of Kazakhstan;

21) the implementation of gender policy within its competence;

22) the implementation of organizational preparation and conduct of activities on the elections issues in the framework of the legislation on elections in the Republic of Kazakhstan;

23) organization of work on the preparation of documents on issues of administrative territorial structure;

24) implementation of other functions in compliance with the legislation of the Republic of Kazakhstan.

19. The state institution “Apparatus of Akim of  Auliekol District” shall:

1) represent the interests of the akim and akimat of the district;

2) within its competence, request and receive the necessary information, documents and other materials from state bodies and officials and other organizations on issues of competence of the akim and akimat of the district;

3) give the necessary instructions to the heads of organizations located in the district on issues of their competence;

4) interact with other government bodies, public self-government bodies and other organizations on issues of improving management efficiency in the relevant territory;

5) exercise other rights in compliance with the current legislation.

20. Obligations of the state institution “Apparatus of Akim of  Auliekol District”:

1) observance of the current legislation of the Republic of Kazakhstan;

2) high-quality and timely execution of acts and instructions of the President, the Government and other central executive bodies, as well as the akim and akimat of the region, akim and akimat of the district.

3. Organization of activities of a state body.

21. The state institution “Apparatus of Akim of  Auliekol District” shall be administered by the first leader, who is personally responsible for the fulfillment of the tasks assigned to the state institution “Apparatus of Akim of  Auliekol District” and the exercise of his functions.

22. The powers of the head of the state institution “Apparatus of Akim of  Auliekol District”:

1) to represent the state institution “Apparatus of Akim of  Auliekol District”in state bodies and other organizations;

2) to organize and supervise the work of the state institution “Apparatus of Akim of  Auliekol District” and be personally responsible for the fulfillment of the functions and tasks assigned to it, as well as for failure to take measures to combat corruption;

3) to develop  regulations on the state institution “Apparatus of Akim of  Auliekol District”, proposals on the structure and staff number and submit them to the Akimat for approval;

4) to establish the internal labor schedule, to carry out general management and coordination of the activities of structural units, to approve the provisions on them, to approve the duties and powers of the heads and specialists of departments of the state institution “Apparatus of Akim of  Auliekol District”;

5) to appoint, release and bring technical workers of the state institution “Apparatus of Akim of  Auliekol District” to disciplinary liability in compliance with the current legislation of the Republic of Kazakhstan ;

6) to control the implementation of legislation on public service;

7) to issue orders and give instructions binding upon the employees of the state institution “Apparatus of Akim of  Auliekol District”;

8) to submit to the akim for signature resolution drafts of the akimat, decisions and orders of the akim of the district;

9) to coordinate the work on monitoring the implementation of adopted resolutions of the akimat, decisions and orders of the akim of the district;

10) to control the work with personnel in compliance with the current legislation on public service and labor legislation;

11) to sign the official documentation within the competence;

12) to carry out a personal reception of individuals and representatives of legal entities;

13) if necessary, to form working groups for the development of draft regulatory legal acts, programs and other documents;

14) within his competence, to manage the funds of the state institution “Apparatus of the Akim of Auliekol District”, to sign financial documents;

15) to perform other functions assigned by the akim.

The execution of the powers of the first head of the state institution “Apparatus of Akim of Auliekol District” during his absence shall be carried out by a person who replaces him in compliance with the current legislation.

4. The work schedule of the state body.

23. The work schedule of the state institution “Apparatus of Akim of  Auliekol District” shall be prescribed by the internal labor regulations and shall not contradict the provisions of labor legislation of the Republic of Kazakhstan.

5. Property of a state body.

24. The state institution “Apparatus of Akim of  Auliekol District” may have separate property on the right of operational management in cases stipulated by law.

The property of the state institution “Apparatus of Akim of  Auliekol District”shall be formed at the expense of the property transferred to it by the owner.

25. The property assigned to the state institution “Apparatus of Akim of  Auliekol District” shall  belong to communal property.

26. The state institution “Apparatus of Akim of  Auliekol District” shall not be entitled to alienate or otherwise dispose of property assigned to it and property, obtained with funds according to the financing plan, unless otherwise provided by law.           

6.Reorganization and liquidation of a state body.

27. Reorganization and liquidation of the state institution “Apparatus of Akim of  Auliekol District” shall be carried out in compliance with the legislation of the Republic of Kazakhstan.
